Building Official Fast APPROVED In accordance with the 2018 International Existing Building Code (IEBC) Section 306.7.1, alterations affecting an area of a building must include accessibility improvements to the maximum extent feasible, with the cost of such improvements required to be at least 20 percent of the overall alteration cost. The current project involves remodeling of the elevator lobbies and public restrooms on the floor of 5151 E Broadway, with a construction valuation of $125,500.

Accessibility improvements identified within this scope of work include the installation of bottle less water coolers in place of inaccessible units ($5,300), two touchless air hand dryers ($3,300), two touchless faucets ($990), and upgraded signage ($770), totaling $10,360. These improvements represent approximately 12.11 percent of the overall project valuation.

While this falls below the 20 percent threshold, additional accessibility upgrades can reasonably be implemented to meet the intent of IEBC 306.7.1 without requiring full restroom renovation. Examples include installation of automatic door openers, placement of directional signage on every floor, addition of grab bars within restroom stalls, improved lighting and visual contrast for the visually impaired, and adjustment of reach ranges for sanitary seat cover dispensers.

Through incorporation of these additional measures, the project will achieve compliance with IEBC 306.7.1 by ensuring accessibility improvements equal to or exceeding 20 percent of the total cost of alterations, thereby enhancing usability and meeting the code’s requirement for proportional accessibility upgrades.

1. The appeal does not appear to show the proposed design complies with the intent of the provisions of this code, and that the method offered by the appeal is less than the equivalent of that prescribed in this code. The research is below.
2. The proposed in lieu of literal compliance of directing occupants to the 1st floor from the 11th floor does not meet the intent of IBC 2902.3.4 which states in part; The toilet facilities shall be located not more than one story above or below the space required to be provided with toilet facilities. Commentary: To prevent health problems for building occupants related to difficulty in accessing a needed toilet facility in a timely fashion, the code clearly provides two conditions that must be met: the required toilet facilities must be located within a certain travel distance; and the building occupant must not be required to travel beyond the next adjacent story above or below his or her location.
3. This allowance in was overlooked in the appeal. IEBC 305.8.10 Allows an alternative where it is technically infeasible to alter existing toilet and bathing rooms to be accessible, an accessible family or assisted-use toilet or bathing room constructed in accordance with Section 1109.2.1 of the International Building Code is permitted. The family or assisted-use toilet or bathing room shall be located on the same floor and in the same area as the existing toilet or bathing rooms. At the inaccessible toilet and bathing rooms, directional signs indicating the location of the nearest family or assisted-use toilet room or bathing room shall be provided. These directional signs shall include the International Symbol of Accessibility and sign characters shall meet the visual character requirements in accordance with ICC A117.1.
4. The appeal states the reason for the appeal is “Not readily achievable to make existing restrooms ADA compliant due to concrete structure.”
A. It appears the existing restroom could possibly be reconfigured to allow for an accessible restroom.
