External Reviewers - Davis Monthan AFB REVIEW COMPLETED We have discussed this proposed project with City personnel in the last 6 months. We are aware part of the site sits within the ADC but no occupied structures seem to be planned within the ADC. However, there are structures planned in future phases within the NCD-2. Previous discussions mentioned there would be a need for the special exception as the proposed uses would be prohibited in the NCD-2without appropriate sound attenuation. DMAFB discussed this with Wing leadership and we find with this being a CoT request, we have no objections for the police satellite office and future fire department as planned.
External Reviewers - PC RFCD REVIEW COMPLETED The Regional Flood Control District (District) has received and reviewed the request for a Special Exception to the performance standards for development within the Airport Environmental Zone. This is a phased project with the first phase proposing the construction of an approximate 4,500-square foot office-use facility for use by Tucson Police Department, with the second phase anticipated to be a future conversion to a fire station for Tucson Fire Department.
District staff has reviewed the Preliminary Development Plan (PDP) and Design Compatibility Report (Report) and has the following informational comments which the District requests to be considered at the time of site development;
1. A Federal Emergency Management Agency (FEMA) Special Flood Hazard Area (SFHA) Zone A impacts this property. As such, the structure shall be placed out of the SFHA and a Letter of Map Revision shall occur through FEMA.
2. This property is not impacted by a District mapped local floodplain and is not located within mapped Regulated Riparian Habitat, although the District has identified an approximate flow path for a regulatory discharge estimated to convey less than 500 cfs in a 1% chance storm event. The PDP shows a culvert which appears to convey flow in the existing conditions alignment which the District requires to assure that flows continue to be conveyed to the existing inlet to the Kolb Basin outlet channel.
3. Essential emergency response facilities, such as police stations, fire stations, emergency shelters and/or operation centers that are needed for public safety and/or flood response activities before, during and after a flood are considered critical facilities. Any critical facility shall be protected from the five hundred-year floodplain (a two-tenths percent annual chance).
4. A drainage report was not submitted with the Design Compatibility Report. Drainage infrastructure was shown on the PDP but not labeled and the standard drainage information (Q100, dimensions, pipe diameter, etc) was also not provided on the plan. For example there is what appears to be a large basin located east of the structure and supporting site infrastructure but there is none of the standard drainage information provided on the PDP. Consequently, to determine if the proposed drainage design creates an adverse impact to adjacent properties and is adequately designed was not possible. It is also not clear how Phase 2 will impact the proposed basin.
5. The parcel is located adjacent to District parcel 114 10 005E, the Kolb Basin, and the District has full maintenance responsibility. It is the District’s expectation that drainage shall follow the existing natural topography and be directed north towards the outfall channel of Kolb Basin. Based on the PDP it appears this is the intent of the applicant however more detailed drainage information should be provided to determine District acceptance of the overall project design.
The District does not object to the approval of the Special Exception subject to the following conditions:
a. Prior to other site permit approvals, the District shall review and approve the project Drainage Report.
b. Any impacts to District property or facilities shall require a Facility Impact Permit.

Kolb Road Special Exception, to construct a TPD police substation (Protective Service use), with a second phase anticipated to be a future conversion to a Tucson Fire Department station.
The Special Exception site (site), addressed as 7655 S. Kolb Road, is approximately 4 acres in area, located on the east side of S. Kolb, approx. ⅔ mile north of Interstate 10. The site has City of Tucson RH (Rural Homestead) zoning and is currently undeveloped but has been subject to some clearing of vegetation. The site is surrounded by other undeveloped parcels, flood control infrastructure, high density single family residential development and industrial facilities.
Portions of the site are located within the Davis-Monthan Air Force Base (DMAFB) Airport Environs Overlay Zone (AEZ), to ensure safe aircraft approach and departure, avoid the concentration of population in potential accident areas, and reduce the potential for harmful effects of high noise level exposure on humans in the vicinity of DMAFB. Roughly the eastern half of the site is within the DMAFB Approach-Departure Corridor-2 (ADC-2), and over three-quarters of the site is within Noise Control Zone-A (NCZ-A), within the 65-70 Day-Night Average Sound Level (LDN) Noise Contour.
The proposed Protective Service use is permitted in both the RH zone and ADC-2, proposed development appears to lie outside of the ADC-2 boundary, and the Design Compatibility Report addresses the property being undersized for the 5-acre minimum site area for uses in ADC-2. The proposed use is within a growing area of the City of Tucson, and is likely a much-needed service.
Pima County Development Services Department, Planning Division has no opposition to the proposed special exception. Comment from other county departments are included below.

The special exception request is for the proposed office-use facility to be later converted to a fire station. The property is located on Kolb Road, north of the I-10 at the intersection of E. Camino Boleadoras.

Sewer service is available for this development in the 10-inch public sewer G-83-043, downstream from manhole 4277-06 (Type I P22WC00181, dated June 10, 2022). Allocation of capacity is made by the Type III Capacity Response.

The PCRWRD has no objection to the special exception request and offers the following wastewater requirements:

The owner(s) shall not construe any action by Pima County as a commitment to provide sewer service to any new development within the project site until Pima County executes an agreement with the owner(s) to that effect.

The owner(s) shall obtain written documentation from the Pima County Regional Wastewater Reclamation Department (PCRWRD) stating that treatment and conveyance capacity is available for any new development within the proposed project site, no more than 90 days before submitting any tentative plat, development plan, preliminary sewer layout, sewer improvement plan, or request for building permit for review. Should treatment and / or conveyance capacity not be available at that time, the owner(s) shall enter into a written agreement addressing the option of funding, designing and constructing the necessary improvements to Pima County’s public sewerage system at his or her sole expense or cooperatively with other affected parties. All such improvements shall be designed and constructed as directed by the PCRWRD.

The owner(s) shall time all new development within the project site to coincide with the availability of treatment and conveyance capacity in the downstream public sewerage system.

The owner(s) shall connect all development within the project site to Pima County’s public sewer system at the location and in the manner specified by the PCRWRD in its capacity response letter and as specified by PCRWRD at the time of review of the tentative plat, development plan, preliminary sewer layout, sewer construction plan, or request for building permit.

The owner(s) shall fund, design and construct all off-site and on-site sewers necessary to serve the project site, in the manner specified at the time of review of the tentative plat, development plan, preliminary sewer layout, sewer construction plan or request for building permit.

The owner(s) shall complete the construction of all necessary public and/or private sewerage facilities as required by all applicable agreements with Pima County, and all applicable regulations, including the Clean Water Act and those promulgated by ADEQ, before treatment and conveyance capacity in the downstream public sewerage system is permanently committed for any new development within the project site.

T22SE00042, represented by the City of Tucson. The City of Tucson plans a two-phased development of parcel 141-22-004W, initially for use by the Tucson Police Department and then for use by the Tucson Fire Department. This parcel is zoned from RH (Rural Homestead), and according to the message we received on 12/20, “[this] use is allowable for the zoning and the deed for the land was written for this use.” Parcel - 004W covers 4.0125 acres ± and is situated in the southwest quarter of the northwest quarter of Section 20, Township 15S Range 15E.
The development site address of 7655 S Kolb Road lies just north of the intersection
between S Kolb Road and Interstate 10. This site lies 2,952 feet ± within the Tucson
International Airport Avigation Easement boundary. This site also lies within Federal
Aviation Administration traffic pattern airspace.
The Tucson Airport Authority conditionally approves the subject preliminary
development plan request contingent upon the conditions of approval noted below.
These conditions must be included in the development plans.
Conditions of approval:
1. “According to the Federal Aviation Administration (FAA) Notice Criteria Tool, the
‘proposed structure exceeds an instrument approach area by 13 feet and
aeronautical study is needed to determine if it will exceed a standard of subpart C
of 14CFR Part 77’. Additionally, the ‘proposed structure is in proximity to a navigation
facility and may impact the assurance of navigation signal reception’. The FAA
requests that you file.”

the FAA at least 45 days before construction activities begin for each proposed
project unless the FAA staff, with the Obstruction Evaluation / Airport Airspace
Analysis (OE/AAA), provides the project applicant with written communication
that filing FAA Form 7460 is not required. It is highly recommended that the
applicant file earlier than 45 days to provide the applicant with sufficient time to
respond to any concerns identified by the FAA. Note that cranes proposed to be

2. New curb returns shall be constructed with new concrete curb per P.A.G. standard 209.
3. New concrete sidewalk along arterial streets shall be 6 Ft wide and per P.A.G. standard 200.
4. Where adjoining sidewalk from the property ties to sidewalk along the ROW frontage, a 60” X 60” ADA landing is required. Landings shall be 60” X 60” and not to exceed a 2% cross slope in all directions.

This plan has been reviewed for compliance with applicable development criteria in the City of Tucson Unified Development Code (UDC) Administrative Manual (AM) Section 2-11 and Technical Manual (TM) Section for landscape, native plants and water harvesting.

The comments provided are preliminary and are not to be assumed as a complete review of the proposal. During the Development Package review process, a full review will be made by Landscape/NPPO to assure compliance with the applicable UDC development criteria and Technical Standards.

COMMENTS:
1. There must be a NPPO. An NPPO is required per UDC 7.7.3-B. The NPPO is intended to encourage preservation in place of healthy native plants through sensitive site design that minimizes the disruption of areas within the site containing plants while allowing for salvage and transplantation of plants on the site that are likely to survive. A Native Plant Preservation Plan, Section 7.7.4, is required to be submitted or approved or a request for an exception from the Native Plant Preservation requirements approved in accordance with Sections 7.7.3.D.3 & .4 of the UDC and Admin. Manual Section 2-11.0.0 prior to Grading Plan approval. Maximize the number of preserve in place specimens to the fullest extent possible.
2. There will need to be a street landscape border on S Kolb per UDC 7.6.4.C-2 and Table 7.6.4-1. See UDC 7.6.4.C for landscape border requirements.
3. There will need to be retention and detention located on site. See Engineering comments for the guidance on this.
4. See Engineering notes on Julian Wash that runs across the site and balanced critical basin concerns.
5. Maximize rainwater harvesting across the entire site into the landscaped areas, this includes all landscape borders.
6. The use of flush curbs and parking blocks is strongly encouraged in all vehicular parking areas and adjacent to all landscape borders to help maximize rainwater harvesting across the site.
7. A Commercial Rainwater Harvesting Plan is required per The TSM 4-01.3.0. As part of the re-zoning conditions, the applicant should be able to illustrate how water harvesting will meet 60% of the annual landscape water demand, through the use of treatments like flush curbs and basins in the landscape borders.
8. Adherence to the Low Impact Development Standards outlined in Section 5 of the PCRFCD Design Standards for Stormwater Detention and Retention is required and shall work in conjunction with the Commercial Rainwater Harvesting design. Using Low Impact Development design and water harvesting provides critical basin detention and first flush retention for all new development and impervious area.
