COMMENTS: the following comments are relative to an application for NPZ Review (UDC 5.10.3).

This site is located in the NR-1 zone (UDC 5.10.3). A single-family residence (SFR) is a permitted use in this zone (Table 4.8-2). See Use-Specific Standards 4.9.7.B.5 – 9.

1. This comment was not addressed. Prior to zoning approval an NPZ review and approval is required. Owner is proposing to rebuild existing shade structure and add a storage container. The property fronts Waverly Street. As a residential plot plan was not provided it is not clear what the proposed setbacks to either structure is.

COMMENTS: the following comments are relative to an application for a Design Development Option (DDO) (UDC 3.11.1).

The required perimeter yard setbacks for the NR-1 zone interior property lines is the greater of six (6) feet, or two-thirds (2/3) the height of the structure’s wall facing each interior property line (Table 6.3-2.A). Perimeter yard setbacks are based on a measurement from design grade to the highest point of the exterior wall UDC Article 6.4.5.B & Figure 6.4.5-A.
2. Based on a height of 8’-0” the required perimeter yard setback from the proposed shade structure to the east property line is 6’-0”. The Design Development Options (DD0) must be approved prior to approval of this plan.

03/09/2023 Zoning Modifications - DDO REQUIRES RESUBMIT COMMENTS:

1. Address all zoning comments prior to next resubmittal.

2. Based on a height of 8’-0” the required perimeter yard setback from the proposed shade structure to the east property line is 6’-0”. At a minimum the neighbors signoff must be provided on the plot plan. If you are unable to secure a neighbor’s signoff than a Design Development Options (DD0) must be submitted and approved. See information for a DDO below.

Per UDC Article 6.6.2.D An accessory structure , except for an accessory dwelling unit , that exceeds the allowable height of a wall within a perimeter yard and is detached from a principal structure shall comply with the perimeter yard width standards of the principal structure , except that the accessory structure may be built to a parcel line with the consent of the adjoining or, when separated by an alley, adjacent property owner(s) or as permitted by Section 6.6.5, Urban Agriculture Uses and Activities. That if either structure does not meet the required perimeter yard setback a neighbors setback waiver is required. To secure this neighbor setback waiver the following statement must be provided on the plot plan and be signed and dated by the adjacent property owner(s):
