EXPLANATION OF WHY CONFORMANCE WITH THE ABOVE REQUIREMENT PRESENTS AN UNUSUAL PROBLEM: The removal of this underground storage tank will greatly disrupt the normal operation of this business. Two fo the lifts in our facility are mounted over the tank and will require complete diassembly during the tank removal process and cannot be reassembled until after the concrete has cured. This will have a very significant financial impact on our business. (pictures in business file).

STATE SPECIFICALLY WHAT IS PROPOSED IN LIEU OF LITERAL COMPLIANCE:
We are proposing to empty the tank of remaining oil and permanently filling it with approved slurry (sand/water mixture). Naturally the work will be performed by an AZDEQ licensed contractor. All piping associated with this tank will be removed and all tank openings permanently sealed.
