12/02/2010 INSP - FULL RDUARTE Approved Petition of appeal to the Fire Code Official: 1028.2 & 1008.1.8: Exit doors must be readily openable without the use of a key or special knowledge or special effort door must be accessible at all times.

EXPLANATION OF WHY CONFORMANCE WITH THE ABOVE REQUIREMENT PRESENTS AN UNUSUAL PROBLEM:
1. Exit door plans from Patio area to bldg fire exit corridor- exit door swings in (exit flow) and is equipped with panic hardware- the business owner has no way of securing the bldg after hours without the use of a dead bolt locking device installed on the door.
2. Exit gate as per plans from patio area will be installed with panic device hardware and the business owner has no way of securing the patio area when the business is closed- someone could reach over the gate or through gate and push panic device open which will leave patio area and bldg areas to burglaries.

STATE SPECIFICALLY WHAT IS PROPOSED IN LIEU OF LITERAL COMPLIANCE:
1. Exit door to bldg in addition to existing panic device add a single cylinder dead bolt lock to secure bldg when business is closed and bldg and patio have no occupants- existing door is labled. also the door has and exit sign and ER lighting installed above the door. Unlocking the deadbolt will be part of the employee's daily checklist for opening and closing business
2. Gate exit per plan install a luminous exit sign next to gate exit install panic device per plan, no locking device if deadbolt in note 1 is approved. Business owner will cable lock all chairs/tables after business is closed because patio area will be easily accessible without a locking device on the gate panic hardware. In lieu of cable locks, bus. owner would like to have a double cylinder deadbolt lock on the gate to secure the patio area also. A sign will be installed stating "This door to remain unlocked whenever the bldg is occupied" and as part of the employee checlist will be unlocking the gate.
3. Patio only signage will be installed on the interior of the glass doors leading from the inside of the bldg to patio area.

DECISION OF THE FIRE OFFICIAL: Approved with stipulations per Dan Uthe Fire Marshal-
1. Required exit door leading into the bldg from patio pay have a single cylinder dead bolt lock. A sign stating "This door to remain unlocked when the bldg is occupied" shall be posted on the interior of the door. The sign shall be in letters 1" high on a contrasting background.
2. Gate exit shall have panic hardware installed, with no other locking device allowed. An illuminated exit sign shall be installed adjacent to the gate.
3. A sign stating "Patio Only" shall be affixed to the exterior side of the non-required exit doors leading into the patio.
