09/30/2010 | INSP - FULL | RDUARTE | Approved | Petition of appeal to the Fire Code Official for: 603.4- portable unvented fuel fired heating equipmentbe prohibited in occupancies in Group A. EXPLANATION OF WHY CONFORMANCE WITH THE ABOVE REQUIREMENT PRESENTS AN UNUSUAL PROBLEM: Elimination of use of LPG space heaters will greatly impact business, it would dramatically reduce business during highest revenue producing months as over half of seating is located in patio. Alternative heating methods electrical & radiant heat have been greatly explored, these alternatives are more costly than the business can afford to contract, engineer and create additional power for. STATE SPECIFICALLY WHAT IS PROPOSED IN LIEU OF LITERAL COMPLIANCE: In lieu of LPG space heaters, would like to install CSA certified infared Tube heaters that are designed for indoor use. I believe this device will meet fire code standards of safety and allow the use of the patio during winter months. DECISION OF THE FIRE CODE OFFICIAL: APPROVED WITH STIPULATIONS BY CHIEF DAN UTHE: Approved request to continue to use existing gas heaters with the following stipulations: 1. Provide documentation of an installation permit for the existing gas line. 2. All heaters shall be listed and used per the manufactures recommendations, including that the required clearances are maintained. 3. The overhead netting and rollout cover shall be appropriately treated with an approved fire retardant in accordance with the NFPA 701 Standard. Additionally, documentation is provided by the agency that treated the material. |
