No person shall keep or store, nor shall any permit be issued to keep or store, any explosives at any place of habitation, or within 100 feet thereof. EXCEPTION: Storage propellant, black powder, and small arms primers for personal use and not for resale in accordance with section 3306. EXPLANATION OF WHY CONFORMANCE WITH THE ABOVE REQUIREMENTS PRESENTS AN UNUSUAL PROBLEM: The location of SANE productions LLC is a residence and is only a storage place for the equipment and will never be used to meet with clients or to produce any part of the show. The company hopes to fall under the exception of IFC 3301.2.1 as the black powder that is stored will be purchased and used by Amos Carver and not sold or delivered to any other person or company. The hope is that this makes Mr. Carver the end user and therefore considered for "personal use". STATE SPECIFICALLY WHAT IS PROPOSED IN LIEU OF LITERAL COMPLIANCE: The Company hopes to perform this show 20-30 times per yr, at this rate 5 lbs of black powder should last 6 months of shows. The black powder will be kept in it's original container and placed inside a wood lined locked steel box. The locked steel boxes are housed on a rubber covered shelf inside of a Liberty gun safe. The safe is bolted to a concrete floor with four 1/2"x4" bolts, the doors is a three tumbler combination with four locking points. The safe is in a 10'x10' concrete block bunker separate from the house, with a 4" steel and wood door with a slide bar to latch it and a hardened shrouded masterlock to lock it. A charged ABC commercial fire extinguisher is kept in the bunker at all times. no construction of any explosives will take place at this location. DECISION OF THE FIRE CODE OFFICIAL: Approved with stipulations: All storage of black powder shall be in the designated gun safe, within the designated storage building. A maximum of five (5) pounds of black powder shall be stored in the gun safe. A 4A 20BC fire extinguisher shall be mounted and accessible within the storage building. The gun safe shall be a minimum of nine (9) feet from the property line. Assembly of explosive devices on-site shall be prohibited. PER CHIEF DAN UTHE FIRE MARSHAL. 08/10/10 |
