05/05/2010 INSP - FULL RDUARTE Approved Petition of Appeal to the Fire Code Official for: IFC 807.1.2: Combustible decorative materials.

Explanation of why conformance with the above requirement presents an unusual problem: in 2004, fire inspector was concerned, but OK'd it. there is nothing like this place and its decorations in the world!. Actually, we have people come from all over the globe to see. This is financially advantageous for our business. To have to take this stuff down would gut the place of its personality, hence, the soul of east coast super subs.

State specifically what is proposed in lieu of literal compliance:
We have whole heartedly agreed to use and protect all items with state of the art protection to help any and all hazards. We are very mode open to all suggestions and laws to abide.

PER INSPECTOR JOHN VINCENT MEMO HE FEELS COMFORTABLE ALLOWING EAST COAST SUPER SUBS TO COVER THEIR ENTIRE CEILING WITH SPORT JERSEYS AS LONG AS THEY ARE NOT HANGING AND TREATED WITH FLAME RETARDANT.

DECISION OF THE FIRE CODE OFFICIAL: Approved with stipulations.

1. The combustible decorations displayed on the ceiling shall be treated with fire retardant material per NFPA 701. The decorations shall be maintained fire retardant and retreated as necessary.

2. All combustible decorations shall be affixed flat to the ceiling. Decorations shall not hang vertically from the ceiling, except the hats. Even treated, the vertically hanging material does not meet the flame propagation performance criteria of NFPA 701.

PER CHIEF DAN UTHE FIRE MARSHAL 05/05/2010.
