EXPLANATION OF WHY CONFORMANCE WITH THE ABOVE REQUIREMENT PRESENTS AN UNUSUAL PROBLEM: Contractor is not willing to do hydrostatic test on old bottles. Plans for construction of a new restaurant on adjacent lot have been submitted for approval. Upgrading the old building to UL 300 standards is expensive and an unnecessary financial burden due to the fact that the construction of a new restaurant is in process. STATE SPECIFICALLY WHAT IS PROPOSED IN LIEU OF LITERAL COMPLIANCE: The business manager is agreeable to installing an additional Class K extinguisher for additional protection while the original hood system is in use. DECISION OF THE FIRE CHIEF- Chief Dan Uthe Deputy Chief/Fire Marshall: Approved with stipulations: 6 month time extension to 10/26/10 for the upgrade to current fire extinguishing system. If new restaurant not completed by October, additional time may be granted. And as stated in the appeal you will provide additional Class K fire extinguisher. |
