04/27/2010 INSP - FULL RDUARTE Approved Petition of appeal to the Fire Code Official for: Fire access road for the Desert Cove subdivision to be graded to a minimum width of 20 feet. Tucson Fire Code Sec 503.2.1.

EXPLANATION OF WHY CONFORMANCE WITH THE ABOVE REQUIREMENT PRESENTS AN UNUSUAL PROBLEM:
The Block/Haskin Family Revocable Trust (Block trust) is the owner of a private 20 foot ingress/egress easement that is coincidental with the fire access road for the Desert Dove Subdivision. The Block Trust is hereby appealing the 20 foot wide grading requirement of Tucson Fire Code Sec 503.2.2 for a fire access road. the reasons for the appeal are:
1. The fire access rd is near and in some stretches adjacent to the Este Wash, which is protected ERZ wash with substantial riparian vegetation and habitat that is home to numerous birds and animals. Grading the fire access rd to a full 20 foot width would destroy much riparian vegatation.
2. The Block Trust has maintained this easement for the past 16 years. The current width of the graded portion of the easement is more than adequate to accomodate large vehicles.
3. Widening of the graded portion of easement could encourage unauthorized traffice on private ingress and egress easement.
4. Fire access road consists primarily of low desert shrubs and grasses that would hardly be an impediment to emergency vehicles traveling over the easement.

STATE SPECIFICALLY WHAT IS PROPOSED IN LIEU OF LITERAL COMPLIANCE:
The Block Trust request that the grading of the fire access road on the Desert Cove subdivision be reduces to 15 feet, rather than the currently required 20 feet.
