EXPLANATION OF WHY CONFORMANCE WITH THE ABOVE REQUIRMENT PRESSENTS AN UNUSUAL PROBLEM: As per letter CPES is currently renting property on Drachman St for use as a residential licensed site for those with a serious mental illness. Fire Sprinklers system requires a significant financial investment. This agency wants to invest in a property it owns. Current property owner will not install fire sprinkler system as it would not be required for non-disabled residents, CPES budget does not allow for home purchase until calendar year 2010.

STATE SPECIFICALLY WHAT IS PROPOSED IN LIEU OF LITERAL COMPLIANCE: CPES has engaged a real estate agent to locate a property for CPES to purchase and install a fire sprinkler system (if required by that fire district) before October 2010. This would entail vacating the Drachman property by that date.

DECISION OF THE FIRE CODE OFFICIAL:
APPROVED WITH STIPULATIONS:
1. By September 1, 2010 an automatic fire sprinkler system shall be installed or,
2. Reduce the licensed capaticy to 6.
