11/10/2008 INSP - FULL RDUARTE Approved petition of appeal to the fire marshall- this is a residential assisted living facility licensed for 10 clients/residents. Some of the clients are "wanderers." They would like to use a double-keyed deadbolt on their front door. The house has a Residential Sprinkler System and a FD lock box installed. They are appeal the following TFD:
1008.1.8 Door operations
1024.6 Access to a public way
Exception: Where access to a public way cannot be provided, a safe dispersal area shall be provided where all of the following are met:
1. The area shall be of a size to accomodate at least 5 sq ft (0.28 m2) for each person.
2. The area shall be located on the same lot at least 50 feet (15 240 mm) away from the bldg. requiring egress.
3. The area shall be permanently maintained and identified as a safe dispersal area.
4. The area shall be provided with a safe and unobstructed path of travel from the bldg.

Their backyard does not meet the 50 ft exception. They have 5 sq ft/person but approximately 35-40ft away, not 50 ft. If we continue to interpret 1024.6 as we have in the past then I think they meet the intent of the code.
