ACCORDING TO CITY RECORDS (PERMITS AND CODES DATA-BASE), THE ABOVE REFERENCED PIA BETWEEN ADVANCED ENERGY TECHNOLOGIES INC AND THE CITY OF TUCSON HAS BEEN UNDER CONSTRUCTION SINCE MAY 2, 2001, THE PERMIT HAS NEVER BEEN RENEWED AND THE PROJECT HAS NOT BEEN COMPLETED WITHIN THE 2-YEAR PERIOD AS REQUIRED IN THE PIA CONTRACT.

CONSEQUENTLY, THE RIGHT-OF-WAY IMPROVEMENTS HAVE NOT BEEN ACCEPTED FOR MAINTENANCE AND WILL NOT BE ACCEPTED UNTIL THE FOLLOWING ITEMS (AT A MINIMUM) ARE ADDRESSED:

PER THE PIA CONTRACT PARAGRAPH 10: "THE APPLICANT AND/OR THE CONTRACTOR SHALL, PRIOR TO PLACEMENT OF MATERIALS, FURNISH THE CITY ENGINEER WITH A CERTIFIED REPORT THAT MATERIALS TO BE USED IN THE PROPOSED CONSTRUCTION ARE IN COMPLIANCE WITH THE REQUIREMENTS OF THE CITY OF TUCSON/PIMA COUNTY STANDARD AND DETAILS." -- AS OF THIS DATE NO SUCH MATERIALS HAVE BEEN SUBMITTED TO THIS OFFICE.

PER THE PIA CONTRACT PARAGRAPH 12: "APPLICANT SHALL CONTACT THE CITY ENGINEERING MATERIALS LABORATORY AT 791-3127, 48-HOURS PRIOR TO PLACEMENT OF ANY ASPHAULT-CONCRETE PAVEMENT FOR APPROVAL OF THE APHALT-CONCRET MIX PRIOR TO ITS PLACEMENT".-- AS OF THIS DATE NO SUCH REQUEST HAS EVER BEEN MADE TO THIS OFFICE.

PER THE GENERAL CONDITIONS SECTION 7: PERMITS

"THE APPLICANT SHALL, AT ITS SOLE COST AND EXPENSE, OBTAIN ALL NECESSARY PERMITS AND LICENSES FOR WORK PERFORMED UNDER THE PRIVATE IMPROVEMENT AGREEMENT, GIVE ALL NECESSARY NOTICES, PAY ALL FEES REQUIRED BY LAW, COMPLY WITH ALL LAWS, ORDINANCES AND REGULATIONS RELATING TO THE WORK, PUBLIC HEALTH, AND SAFETY. ALL RIGHT-OF-WAY EXCAVATION PERMITS WILL BE KEPT CURRENT UNTIL THE COMPLETION AND ACCEPTANCE OF THE PROJECT BY THE CITY OF TUCSON.-- AT THIS TIME PERMIT #T01EX00504 OBTAINED 05-02-01 WAS NEVER RENEWED UPON ITS EXPIRATION DATE. THIS PERMIT IS TO BE RENEWED AND WILL BE TRIPLE FEE'D
A) PLEASE INSURE THAT THE RIGHT-OF-WAY EXCAVATION PERMIT IS CURRENT BEFORE WORKING ON ANY PUNCHLIST ITEMS.

UPON COMPLETION OF THE WORK OUTLINED IN THE PRIVATE IMPROVEMENT AGREEMENT, THE ENGINEER-OF-RECORD AND SURVEYOR-OF-RECORD (IF APPLICABLE) SHALL WITHIN TEN (10) DAYS, FURNISH THE CITY ENGINEER'G OFFICE WITH THE FOLLOWING:

- THE ORIGINAL MYLAR PLAN SET. SAID PLAN SET TO BE STAMPED "AS-BUILT" IN LETTERS NO SMALLER THAN ONE QUARTER-INCH HIGH ON EACH SHEET OF PLAN SET AND SEALED BY ENGINEER-OF-RECORD AND SURVERYOR-OF-RECORD (IF APPLICABLE) ON COVER SHEET.

- A BLUE-LINE, "AS-BUILT" PLAN SET FOR USE BY THE CITY INSPECTOR FOR FINAL INSPECTION.

- AN ENGINEER-OF-RECORD LETTER OF CERTIFICATION STATING: I HEREBY CERTIFY THAT THIS PROJECT HAS BEEN CONSTRUCTED IN SUBSTANTIAL CONFORMANCE WITH THE PIMA COUNTY/CITY OF TUCSON STANDARD AND SPECIFICATIONS AND DETAILS FOR PUBLIC WORKS, THE DEVELOPMENT STANDARDS OF THE CITY OF TUCSON, AND THE PLANS APPROVED BY THE CITY ENGINEER. EXCEPTIONS ARE SHOWN AS "AS-BUILT" NOTATIONS ADDED TO THE APPROVED PLANS AT MY DIRECTION. THE LETTER SHALL BE SEALED, SIGNED AND DATED BY THE ENGINEER-OF-RECORD.

- A SURVERYOR-OF-RECORD LETTER OF CERTIFICATION (IF APPLICABLE) STATING: I HEREBY CERTIFY THAT THIS PROJECT WAS CONSTRUCTED IN SUBSTANTIAL CONFORMANCE TO THE LINE, GRADE AND LOCATION AS SHOWN ON THE PLANS AS APPROVED BY THE CITY ENGINEER. ANY EXCEPTIONS ARE SHOWN AS "AS-BUILT" NOTATIONS ADDED TO THE APPROVED PLANS AT MY DIRECTION. THE LETTER SHALL BE SEALED, SIGNED AND DATED BY THE SURVERYOR-OF-RECORD.

- A LIST OF INSTALLED MATERIALS AND QUANTITIES FOR THE WORK.

- ALL INSPECTION NOTES RELATING TO THE WORK.

- ALL MATERIALS' TESTING DATA RELATING TO THE WORK.

CITY OF TUCSON ENGINEERING DIVISION PERSONNEL SHALL PERFORM A FINAL ON-SITE INSPECTION OF SAID IMPROVEMENT. IF THE INSPECTION REVEALS DEFICIENCIES IN THE WORK, ADDITIONAL OR CORRECTING WORK SHALL BE PERFORMED BY THE APPLICANT PRIOR TO ACCEPTANCE OF SAID IMPROVEMENT BY THE CITY ENGINEER.

TWO SURVEY MONUMENTS HAVE NOT BEEN INSTALLED ON CODD STREET AND HAVE BEEN ACCEPTED IN THAT MANNER BY THE DEPARTMENT OF TRANSPORTATION. CURRENTLY 4 LOTS HAVE NOT BEEN CONSTRUCTED ON AT THIS TIME AND WILL NEED TO BE CHECKED IN THE FUTURE WHEN THE LOTS ARE DEVELOPED, THEY ARE LOTS # 7, 10, 34, AND 59. THIS SITE CAN BE RELEASED ONCE ALL OF THE APPROVAL LETTERS HAVE BEEN RECORDED IN SIRE.
