The Project consists of three industrial buildings which are expected to attract a wide range of industrial, technology, manufacturing and logistics companies. Please note we would like this letter to contain affirmative language stating the following: 1. That the Property is located within the I-1 (Light Industrial) zoning classification; 2. The permitted uses thereunder, with specific confirmation that the use of the Property and structures located thereon (if any) is allowed under the current zoning; 3. That there is compliance with respect to (as applicable): a. Area, width, and depth of the land as a building site for the structures; b. Floor space area for the structures; c. Setback of said structure from property lines; d. Height of said structures; and e. Sufficient parking spaces. 4. That all conditions have been satisfied and an occupancy permit has been issued (if applicable); 5. That the Property is in compliance with all applicable subdivision, ordinances and regulations; and 6. Permitted uses under the current zoning, without the necessity of obtaining a rezoning, conditional use permit or variance, includes, but is not limited to: a. Receiving, storing, assembling, shipping, distributing, preparing, and selling products, materials, food, grocery and liquor items; b. The parking (including tandem parking), storage, and use (including driving into and through the building for loading and unloading and parking inside the building) of automobiles, trucks, machinery and trailers, including outdoor loading and unloading; c. Warehouse and office use; d. Using, handling or storing hazardous materials in accordance with applicable law and in the ordinary course of business, including (i) in any packaged merchandise to be sold, handled, and/or held for shipment to customers, (ii) maintenance of trucks and machinery, and (iii) batteries for any trucks, generators or other machinery or the equipment described in clause (e); e. Installing and operating rooftop equipment such as satellite dishes, cellular antenna, and renewable energy systems, including solar energy systems and related equipment; f. Installing and operating battery storage systems, and electrical generators; and g. Ancillary and related uses for any of the foregoing, all on a twenty-four-hour, seven-days-per-week, fifty-two-weeks-per-year basis.
