Permit Description: The subject property is zoned C-2. The proposed business to be operated on the Property is a modern retail establishment offering apparel, lingerie, swimwear, personal care products, fragrances, lotions, lubricants, gifts, novelty merchandise, massage devices, sexual wellness products, and related consumer goods. The business does not sell pornographic magazines, adult books, DVDs, sexually explicit films, or offer viewing booth or any related on-site services, or similar materials or services historically associated with adult bookstores or adult-oriented retail establishments. Prior to purchasing the Property, the Owner obtained an opinion from the then acting Zoning Administrator, Russlyn Wells, stating that the proposed use is considered General Retail and not Adult Use. A copy of that determination is attached to the Request. Owner has submitted plans for its improvements under application no. TC-COM-0425-00839. As the proposed use is a retail and wellness-oriented business whose merchandise categories substantially align with products commonly sold by national retailers, pharmacies, beauty suppliers, department stores, and online merchants throughout the State of Arizona (including Tucson) and the United States, the proposed use is properly classified as Retail Trade and Owner seeks such determination, which is consistent with the determination made by the Zoning Examiner, Russlyn Wells, through her email correspondence dated August 7, 2024.
