11/09/2009 November 10, 2009 FLOODPLAIN USE PERMIT#: T09OT02400 PROJECT ADDRESS: 7834 E Bellevue St APPLICANT'S NAME: Carla Pothier PROPERTY OWNER: POTHIER STEVEN & CARLA The applicant is authorized to use a portion of the flood hazard area in the City of Tucson, Arizona, on the property described as: A portion of Parcel 133-09-0480 at 7834 E BELLEVUE ST, TUCSON, 85715, PANTANO VISTA LOT 8 in a portion of Township 14S, Range 15E, Section 5, for the purpose of placing a chain link fence within the rear of the lot. The applicant agrees to comply with City of Tucson Floodplain and Erosion Hazard, and Watercourse Amenities, Safety and Habitat regulations, and are particularly bound by the conditions stated below. Violation of any of the conditions stated or referred to below, as determined by the City Engineer, shall be grounds for revocation of this permit. Responsibility for renewal of this permit, if necessary, is with the applicant. Issuance of this permit does not constitute a waiver of other requirements contained in the Tucson City Code, Land Use Code, or any other Federal, State, County, or local regulation. No use other than as permitted herein is allowed. Additional uses allowed under City of Tucson Floodplain and Erosion Hazard Regulations and Watercourse Amenities, Safety, and Habitat regulations require the issuance of an additional Floodplain Use Permit. The following 13 conditions apply to this permit T09OT02400: 1) Chain link fence no higher than 6-feet, spaced at 10-foot sections with anchor poles, with setbacks: a) At rear property line: minimum 10-feet (60-feet from existing pool wall); b) At west property line: 20-feet to new fence (30-feet from west pool wall), and; c) A minimum of 2-feet from east property line (20-feet from east pool wall). 2) Within 5 (five) days of issuance of this permit, and through completion of the project, notification must be posted and maintained in a conspicuous place on the job site stating "CONSTRUCTION PROCEEDING UNDER REQUIREMENTS OF CITY OF TUCSON FLOODPLAIN USE PERMIT # T09OT02400. FOR INFORMATION PLEASE CALL 791-5550." 3) Floodplain Engineering inspections are required. After permit issuance and before commencement of fence installation, call for Pre-construction meeting and subsequent drainage inspections. Contact IVR 740-6970 to schedule a Floodplain inspection, or PDSD Engineering at 837-4991. 4) Except as approved by the City Engineer prior to the start of construction, development under this permit shall not obstruct, retard or divert the existing flow of floodwaters from or to adjacent properties. Unless a separate drainage report is prepared and submitted for review and approval, these conditions apply for chain link fence placement. 5) There shall be no stockpiling of wood, rock, trimmed / discarded vegetative materials, or other materials south of the existing pool wall due to floodplain conditions. 6) Fence shall have a minimum opening of 1-foot, measured from the ground to the lowest section of the chain link fencing, for those east and west sections of the new fence that are within 40-feet south of the existing south pool wall. The remaining east and west sections of the fence shall have a minimum of 2-foot openings, measured from the ground to the lowest section of the chain link fencing. Fence shall have a minimum opening of 2-feet, measured from the ground to the lowest section of the chain link fencing, for the portion of the fence that is located at the south side of the property. 7) Stormwater runoff shall be allowed to flow through and under the fence at all elevated sections of the fence on the east and west sides of the property, and also be allowed to flow out to the south for drain-down conditions. 8) Drought tolerant plants that are no taller, at maturity, than the adjacent openings are permitted downstream of fence openings. Plant material used for landscaping shall be selected from the Drought Tolerant Plant List in Development Standard 2-16.0. 9) No additional vegetation within 5-feet of the fence shall be planted on the upstream side of any portion of the new fence. (No vegetation allowed on the east sides of the east or west portions of the fence.) If there are existing vegetation east of east property line, setback for east portion of the fence may need to be increased. It is recommended that drought tolerant plants that are no taller, at maturity, than the adjacent fence openings, be placed in other locations in the rear of the lot, farther than 5-feet from the fence. 10) Maintenance of fence and vegetation on the property is required, and is the responsibility of the owner, in order to minimize potential for debris flow or blockages during storm events. It is the responsibility of the owner to keep the openings clear of debris at all times. 11) Any disturbance activity outside of the lot boundaries shall be subject to notice of violation, Stop Work Order, citation, and/or other penalties or requirements. 12) This permit becomes invalid and is subject to additional floodplain review, if any required development permit changes the configuration of the site development, or, if there is any further disturbance within the floodplain other than that outlined in this permit. This floodplain use permit may be subject to conditions or restrictions designed to reduce or mitigate the potential damage or hazard to life or property resulting from development within the regulatory floodplain, floodway or erosion hazard areas as determined by the project engineer and accepted by the City of Tucson. 13) This permit does not authorize the construction of building pads or building of other structures other than the required improvements per this approved permit. Any construction shall be authorized by a separate building permit. This Floodplain Use Permit will be automatically revoked and becomes invalid for non-compliance to conditions set forth in this permit. Also, this permit will expire one year from its date of issue. Renewal of this permit will require a new application, review and approval of that application by the City of Tucson, Planning & Development Services Department, Engineering Division.
