T07OT01756 ADDRESS: 1701 West Saint Mary's Road, Suite 103, Tucson Arizona 85745 PROPERTY OWNER: HR Acquisition I Corp (615) 269-8394 3310 West End Avenue #700, Nashville TN 37203 The applicant is authorized to use a portion of the City of Tucson Special Flood Hazard Area, specifically described as: A portion of Parcel 116-15-087D of PART OF E311.91' W580' M/L S568.11' N590' M/L FRACTION LOT 2 LYG ADJ TO & S ST MARYS RD S3.62 AC, T14S R13E Section 10, described as the Violet Juodakus, MD medical office building Suite 103; for the purpose of medical office tenant improvements to an existing, non-conforming floodprone structure. In reviewing this Floodplain Use Permit application for improvements to an existing floodprone structure, it has been concluded that the cumulative value of improvements to this structure, as supported by documentation provided by the applicant, is less than 50% of the current value of the existing structure. The applicant agrees to comply with City of Tucson Floodplain and Erosion Hazard Area Regulations, and are bound by the conditions stated below. Violation of any of the conditions stated or referred to below, as determined by the City Engineer, shall be grounds for revocation of this permit. Responsibility for renewal of this permit, if necessary, is with the applicant. Issuance of this permit does not constitute a waiver of other requirements contained in the Tucson City Code, Land Use Code, or any other Federal, State, or local regulation. No use other than as permitted herein is allowed. Additional uses allowed under City of Tucson Floodplain and Erosion Hazard Regulations require application for, review and approval of an additional Floodplain Use Permit. This floodplain use permit is issued with the following 11 conditions: 1) This project is located in a Zone A Special Flood Hazard Area as shown on FIRM panel 2210K. To assess cumulative substantial improvement, a cost estimate was provided, showing that the improvements are less than 50 % (estimate for T09OT01756 was 3.86%, plus 3.32% from T09OT01755, 0.54% from T07OT00640, the 0.40 from T07OT00345, the 2.3% from T06OT03246 and 0.14% from T06OT01076) indicating a cumulative total percentage of 11% of the assessed value of the structure (excluding land value), as shown on the Pima County Assessor Property Inquiry. No person shall repair or alter property in a piecemeal manner so as to avoid the provisions of Section 26-4.1.a.3, Chapter 26-Tucson Code. The estimate will be recorded and any future improvements will be added to it. 2) This Floodplain Use Permit T09OT01756 is issued concurrently with the associated improvement plans/permit T09CM01955. Copies of these documents shall be kept in a readily accessible location on site at all times. 3) This permit expires December 31, 2010, prior to which, all paperwork showing value/costs for improvements for each separate Saint Mary's structure at this parcel address shall be submitted to the City. 4) The proposed improvements shall not impose conditions that would increase the flood damage potential to the combined proposed and existing building, by greater than 50 percent of the existing structure's value. 5) All future improvements will be cumulative in percentage, to include this project. When the cumulative improvements equal or exceed 50% of the current value of the structure; no other improvements will be permitted unless the entire structure is brought into compliance with the City of Tucson Floodplain and Erosion Hazard Area Regulations (Chapter 26, Tucson Code). If the project is determined to be a substantial improvement, and, if it is determined that the lowest flood elevation is below the regulatory floor elevation, a design submittal, and review and acceptance of the submittal for floodproofing will be required and shall conform to current City of Tucson and FEMA floodplain development requirements in effect on the date of authorization by the Planning & Development Services Department. 6) For future improvements to this structure, a qualified appraisal shall be provided to Planning & Development Services Department - Engineering Division. The appraisal shall serve as documentation, as required, demonstrating that the value of the future improvements to this structure is less than 50% of the current value of the existing structure. An application/processing fee of $50.00 (submittal fee) must accompany each future request for work to be authorized for this building structure. Engineering study review fees of $150.00 may be imposed based upon the fee schedule in the current floodplain ordinance. It shall be the responsibility of the owner to supply the following for all work to be authorized for future improvements: " An 8-1/2" x 11" map locating improvement on the St. Mary's campus " Description of improvement " Provide permit activity number(s) " Title of improvement " Type of assessment used for valuation " Cumulative value of the building structure " Value of improvement in U. S. Dollars " A calculated percent improvement 7) Except as approved by the City Engineer prior to the start of construction, development under this permit shall not obstruct, retard or divert the existing flow of floodwaters from or to adjacent properties. 8) Any work performed offsite shall be agreed to and notarized by any adjacent property owners. Any work performed within the public right-of-way will require permitting through Permits & Codes Section, Engineering Division, Department of Transportation. This permit does not authorize any development, excavation or construction activity in the public right-of-way. 9) The applicant attests to the fact that the plans and documents submitted represent all of the improvements that will be done to the existing building, and that all additions, improvements or repairs to the building are included in the construction plans and/or documents herewith. No other improvements, repairs, reconstruction, additions or remodeling have been made to the structure that is not indicated in the attached plans and/or documents. 10) Renewal of this permit will require a new application, review and approval of that application by the City of Tucson, Planning & Development Services Department, Engineering Division. This permit may be renewed for up to one year, in the absence of Registered Plant authorization, at the sole discretion of the City Engineer or designated representatives. 11) This permit is specific to the improvements for the rooms for the building specified as indicated on the approved plans. It shall not apply to any other structure or property, whether attached or unattached, not specified under this permit. This Floodplain Use Permit will be automatically revoked and becomes invalid if conditions are not complied with, as set forth in this permit.
