T09OT01433 ADDRESS: 9209 East Wrightstown Road Tucson, AZ 85715 PROPERTY OWNER'S NAME: Academy of Tucson The Developer/owner is authorized to use a portion of the flood hazard area in the City of Tucson near the property described as: Academy of Tucson. A portion of Section 3, T-14-S, R-15-E, G.&S.R.M., Pima County, Arizona, for the purpose of constructing a new multi-purpose building and all associated excavation work and drainage structures, within a regulatory floodplain area as shown on the subject project Grading Plan, Case # T09BU01026 (see plans for additional details). The Developer/owner agrees to comply with City of Tucson Floodplain and Erosion Hazard, and Watercourse Amenities, Safety and Habitat regulations, and is particularly bound by the conditions stated below. Violation of any of the conditions stated or referred to below, as determined by the City Engineer, shall be grounds for revocation of this permit. Responsibility for renewal of this permit, if necessary, is with the Developer/owner. Issuance of this permit does not constitute a waiver of other requirements contained in the Tucson City Code, Land Use Code, or any other Federal, State, or local regulation. No use other than as permitted herein is allowed. Additional uses allowed under City of Tucson Floodplain and Erosion Hazard Regulations and Watercourse Amenities, Safety, and Habitat regulations require the issuance of an additional Floodplain Use Permit. The following conditions shall apply to this permit (Refer to Chapter 26 "FLOODPLAIN, STORMWATER AND EROSION HAZARD MANAGEMENT" for additional information): 1. All work shall conform to the subject project Grading Plan Case # T09BU01026 (see plans for additional details), which is made part of this permit. 2. The proposed structure shall be placed on an engineered pad, compacted to 95% density, extending twenty-five (25) feet beyond the buildings foundation, unless a study prepared by a state-registered professional civil engineer and approved by the city engineer shows that a lesser distance is acceptable. 3. No fill shall be placed in any floodway; nor shall any fill be placed where it diverts, retards or obstructs the flow of water to such an extent that it creates a danger or hazard to life or property in the area. 4. The proposed building is impacted by the regulatory floodplain. The floodplain 100-year water surface elevation (WSE) just upstream of the proposed building is 2541.83 feet. The building must be elevated above the floodplain 100-year WSE. This can be achieved by either building up the building pad to the 100-year WSE or higher, or elevating the building by any other acceptable method such as stem walls, piers, etc, depending on what the drainage report, the engineer or the owner is proposing. The building lowest finish floor, utilities, machinery, equipment (i.e. furnaces, water heaters, heat pumps, air conditioners and their associated equipment, including all electrical equipment), or an open utility platform that provides utility services for the structure on this property, under this permit shall be placed at a minimum of 2542.85, at least 1 foot above 2541.83 feet above see level, NAVD 1988, as certified by a Registered Land Surveyor. This Certification (Elevation Certificate) is required and must be completed and returned to Development Services Department, Engineering Division, on the first floor of the County/City Public Works Building at 201 N. Stone Avenue. This Certification must be completed and returned prior to the final inspection, occupancy of the structure, or issuance of Certificate of Occupancy. 5. Two elevation certificates must be completed and returned to the City. The first one, for the forms of the lowest floor, must be completed and returned before the foundation is poured. The second certificate will be required once the construction of building is complete. 6. The disturbed soil, around, underneath and behind the proposed structures, shall be treated based on the geotechnical engineer recommendations and shall be compacted to least 95% density. 7. The existing drainage patterns shall not be obstructed or diverted other than what is shown on the attached approved grading plan. 8. Within 5 (five) days of issuance of this permit, through completion of the project, notification must be posted and maintained in a conspicuous place on the job site stating "Construction proceeding under requirements of City of Tucson Floodplain Use Permit No. T09OT01433. For more information please call 791-5550." 9. Except as approved by the City Engineer prior to the start of construction, development under this permit shall not obstruct, retard or divert the existing flow of floodwaters from or to adjacent properties. 10. This permit becomes invalid and is subject to additional floodplain review, if any required development permit (s') changes the configuration of the structure and or site development. 11. Adhere to specifications outlined in Section C, C2 of the elevation certificate. This Floodplain Use Permit will be automatically revoked and becomes invalid if conditions set forth in this permit are not complied with. Also, this permit will expire one year from its date of issue. Renewal of this permit will require a new application, review and approval of that application by the City of Tucson, Development Services Department, Engineering Division.
