04/14/2008 April 14, 2008 FLOODPLAIN USE PERMIT # T08OT00877 PROJECT ADDRESS: 5115 East Los Reales Road, Tucson Arizona 85706 APPLICANT'S NAME: EEC (Ryan Stucki, PE) PROPERTY OWNER: City of Tucson This parcel lies in a FEMA Zone X-Unshaded (map number 040076 C 2850K). The applicant is authorized to use a portion of the flood hazard area in the City of Tucson, Arizona, on the property described as: Parcel 140-39-052C, 5115 E Los Reales Rd, ELY PTN S2 SE4 60.92 AC, in a portion of Township 15 South, Range 14 East, Section 14, for the purpose of road re-alignment, road construction, and drainage improvements (including temporary basin area and RCP culvert crossings) for the Los Reales Road project. The applicant agrees to comply with City of Tucson Floodplain and Erosion Hazard, and Watercourse Amenities, Safety and Habitat regulations, and are particularly bound by the conditions stated below. Violation of any of the conditions stated or referred to below, as determined by the City Engineer, shall be grounds for revocation of this permit. Responsibility for renewal of this permit, if necessary, is with the applicant. Issuance of this permit does not constitute a waiver of other requirements contained in the Tucson City Code, Land Use Code, or any other Federal, State, County, or local regulation. No use other than as permitted herein is allowed. Additional uses allowed under City of Tucson Floodplain and Erosion Hazard Regulations and Watercourse Amenities, Safety, and Habitat regulations require the issuance of an additional Floodplain Use Permit. The following 12 conditions apply to permit T08OT00877: 1) Call for Pre-construction meeting, elevation certification inspections, and final inspections. For a DSD Engineering Inspection, call IVR (740-6970), or contact DSD Engineering at 837-4991, or schedule inspections online at: http://www.ci.tucson.az.us/dsd/Online_Services/Online_Permits/online_permits.html 2) DSD Engineering Inspections are required prior to SWPPP installation, completion of the drainage improvements, and final floodplain inspection. 3) Within 5 (five) days of issuance of this permit, and through completion of the project, notification must be posted and maintained in a conspicuous place on the job site stating "CONSTRUCTION PROCEEDING UNDER REQUIREMENTS OF CITY OF TUCSON FLOODPLAIN USE PERMIT # T08OT00877. FOR INFORMATION PLEASE CALL 791-5550." 4) This permit becomes invalid and is subject to additional floodplain review, if any required development permit changes the configuration of the improvement, or, if there is any further disturbance within the floodplain other than that outlined in this application. This floodplain use permit may be subject to conditions or restrictions designed to reduce or mitigate the potential damage or hazard to life or property resulting from development within the regulatory floodplain, floodway or erosion hazard areas as determined by the project engineer and accepted by the City of Tucson. 5) Except as approved by the City Engineer prior to the start of construction, development under this permit shall not obstruct, retard or divert the existing flow of floodwaters from or to adjacent properties. 6) All work shall conform to the approved Drainage Report sealed by Craig Hunt, PE (11-20-7), and the approved PIA plans for the Los Reales Road, Early Av to Craycroft Rd, which is made part of this permit. 7) See the associated PIA plan T07PI00028 and the approved Development Plan D07-0037. 8) This Floodplain Use Permit and plans shall be kept in a readily accessible location on site at all times. 9) Any additional future disturbance of the floodplain, including future phases of the Los Reales Landfill project, including other portions of the CRC District development, shall have separate floodplain use permit applications submitted to this office for review and approval. 10) The disturbance area is limited to the minimal construction area needed for constructing the approved road prism, as well as grading and constructing the approved drainage improvements. 11) Disturbance of the floodplain is only permitted as per the approved construction plans. There shall be no wash off area, temporary chemical storage area, temporary refuse area, or other construction storage within the floodplain areas as shown on the plans and as determined by the Drainage Report. 12) Any wash off area, temporary chemical storage area, temporary refuse area, and / or vehicle storage areas shall be placed in non-floodplain areas and shall have interim stormwater controls installed along downstream side of these areas. Downstream side of the road construction area shall also have interim erosion and sediment controls installed and maintained until all disturbed areas are constructed with pavement, curb, sidewalk and revegetation. This Floodplain Use Permit will be automatically revoked and becomes invalid for non-compliance to conditions set forth in this permit. Also, this permit will expire two years from its date of issue. Renewal of this permit will require a new application, review and approval of that application by the City of Tucson, Development Services Department, Engineering Division.
