MACKSTALLER, 4980 NORTH 1st Avenue, C-1 The applicant's property is an approximate 74,088 square foot undeveloped parcel. The applicant proposes a self-storage facility. The proposed use requires compliance with applicable LUC regulations related to new construction. Tucson Land Use (LUC) Code Sections applicable to the project, include, but are not limited to the following: Section 2. 5.3 which provides the development criteria applicable to commercial development in the C-1 (Commercial) zone and Section 3.2.3 which provides the development criteria for building height and Floor Area Ratio (FAR). The applicant is requesting the following variances: 1) Increase the building height from sixteen (16') feet to twenty-six (26') feet; and, 2) Increase the FAR from .75 to 1.01, as shown on the submitted plan. DECISION: VARIANCES 1 and 2: GRANTED WITH CONDITIONS. A. Access to be approved by Traffic Engineering. [DECISION NOTE] By LUC regulation, a building permit or development approval based upon a Board of Adjustment decision cannot be issued, until a minimum of fourteen (14) days after the Board's decision date. IMPORTANT NOTICE VARIANCES GRANTED BY THE BOARD FOR PROJECTS THAT REQUIRE A BUILDING PERMIT BUT A PERMIT HAS NOT YET BEEN OBTAINED, THE PERMIT MUST BE SECURED FROM THE DEVELOPMENT SERVICES DEPARTMENT (DSD) WITHIN 180 DAYS FROM THE DATE OF THIS MEETING. "VARIANCE" APPROVALS EXPIRE WITHIN 180 CALENDAR DAYS FROM THE DATE OF THIS MEETING. TWO ADDITIONAL (180 DAY) EXTENSIONS MAY BE GRANTED PROVIDED THERE IS GOOD CAUSE AND THE REQUEST IS MADE IN WRITING. UNLESS OTHERWISE NOTED. BOARD OF ADJUSTMENT DECISIONS BECOME EFFECTUATED UPON OBTAINING BUILDING PERMIT (IF REQUIRED) AND FULL COMPLIANCE WITH ALL CONDITIONS OF THE BOARD DECISION. THE 180 DAY TIME FRAME TO OBTAIN A BUILDING PERMIT DOES NOT APPLY WHERE THERE IS AN OUTSTANDING ZONING VIOLATION ON THE PROPERTY WHICH PRECIPITATED THE VARIANCE REQUEST.
