PROPERTY OWNER'S NAME: DR Horton Homes The applicant is authorized to use a portion of the flood hazard area in the City of Tucson, Arizona, on the property described as: SLY PT OF NW4 LESS RDS & EXC E400' OF W460' OF N288.28' OF S972.28' THEREOF 123.15 AC SEC 8-15-14 (RD: 7337/1119) (FORMERLY 139-24-001G) For the purpose of final grading for Tres Pueblos Subdivision (Case # S04-003) The applicant agrees to comply with City of Tucson Floodplain and Erosion Hazard Management regulations, and is particularly bound by the conditions stated below. Violation of any of the conditions stated or referred to below, as determined by the City Engineer, shall be grounds for revocation of this permit. Responsibility for renewal of this permit, if necessary, is with the applicant. Issuance of this permit does not constitute a waiver of other requirements contained in the Tucson City Code, Land Use Code, or any other Federal, State, or local regulation. No use other than as permitted herein is allowed. Additional uses allowed under City of Tucson Floodplain and Erosion Hazard Management Regulations require a new application, approval, and issuance of an additional Floodplain Use Permit. The following 12 conditions apply to this permit (see Tucson Code of Ordinances Chapter 26): 1) All work shall conform to the stamped/approved Final Grading Plans (sealed on 8-24-05), and Drainage Report (sealed 8-10-05) for Tres Pueblos, prepared by Rick Engineering Co., which are made a part of this permit. 2) The existing drainage patterns at the property lines shall not be obstructed, other than as may be shown on the approved Tentative Plat, Grading Plans and/or described in the Drainage Report. 3) All grading shall meet the recommendations of the Geotechnical Report prepared and addenda by GRG Consultants Inc., report sealed November 20, 2003, for this project. 4) Except as approved by the City Engineer prior to the start of construction, development under this permit shall not obstruct, retard or divert the existing flow of floodwaters from or to adjacent properties. 5) Within 5 (five) days of issuance of this permit, through completion of the project, notification must be posted and maintained in a conspicuous place on the job site stating "CONSTRUCTION PROCEEDING UNDER REQUIREMENTS OF CITY OF TUCSON FLOODPLAIN USE PERMIT # T05OT01618 - for INFORMATION PLEASE CALL 791-5550." 6) A right-of-way permit is required for any development, excavation, or construction activity within the right of way. Contact Tucson Department of Transportation - Permits and Codes Section, Engineering Division at 791-5100 for questions relating to right of way permit information. 7) This permit becomes invalid and is subject to an additional floodplain permit application and review, if any proposed or required modifications change the configuration of this site development. 8) Any walls to be proposed will require a separate floodplain use permit application and approval prior to construction. Please call Development Services Department at 791-5550 for questions. 9) The western wash improvements, including the markers, shall be the responsibility of the HOA and are indicated for maintenance within the CC&R's. A copy of the recorded revised First Amendment to the CC&R's are required to be submitted to DSD Engineering Division prior to final inspection. 10) Additional percolation Post Grading construction testing may be required. 11) Special inspection required for western channel, W.A.S.H. Ordinance Rodeo Wash, and basins. Inspections for the drainage areas are required following significant storm events and at floodplain inspection. 12) The Stormwater Pollution Prevention Plan (SWPPP) shall be updated as needed and kept on site during grading. This Floodplain Use Permit will be automatically revoked and becomes invalid, if development onsite results in non-compliance with conditions set forth in this permit. This permit will expire two years from its date of issue.
