VIOLATION OF ANY OF THE CONDITIONS STATED OR REFERRED TO BELOW, AS DETERMINED BY THE CITY ENGINEER, SHALL BE GROUNDS FOR REVOCATION OF THIS PERMIT. RESPONSIBILITY FOR RENEWAL OF THIS PERMIT, IF NECESSARY, IS WITH THE APPLICANT. ISSUANCE OF THIS PERMIT DOES NOT CONSTITUTE A WAIVER OF OTHER REQUIREMENTS CONTAINED IN THE TUCSON CITY CODE, LAND USE CODE, OR ANY OTHER FEDERAL, STATE, OR LOCAL REGULATION. NO USE OTHER THAN AS PERMITTED HEREIN IS ALLOWED. ADDITIONAL USES ALLOWED UNDER CITY OF TUCSON FLOODPLAIN AND EROSION HAZARD REGULATIONS REQUIRE THE ISSUANCE OF AN ADDITIONAL FLOODPLAIN USE PERMIT. THE FOLLOWING CONDITIONS APPLY TO THIS PERMIT. (SEE TUCSON CODE OF ORDINANCES CHAPTER 26) 1) THE EXISTING DRAINAGE PATTERNS AT THE PROPERTY LINES SHALL NOT BE OBSTRUCTED. CONSTRUCTION OF ANY WALLS WILL REQUIRE A SEPARATE FLOODPLAIN USE PERMIT. 2) THE LOWEST STRUCTURAL MEMBER OF THE MANUFACTURED HOME DESCRIBED IN THE PERMIT APPLICATION WITH ACTIVITY NUMBER T05MH00047 SHALL BE PLACED A MINIMUM OF 2386.85 FEET ABOVE MEAN SEA LEVEL, NATIONAL GEODETIC VERTICAL DATUM 1929 (NGVD 1929), AS CERTIFIED BY A REGISTERED LAND SURVEYOR. THIS CERTIFICATION MUST BE COMPLETED AND RETURNED TO THE DEVELOPMENT SERVICES DEPT., ENGINEERING DIVISION ON THE 1ST. FLOOR OF THE COUNTY/CITY PUBLIC WORKS BUILDING AT 201 N. STONE AVENUE. THIS CERTIFICATION MUST BE COMPLETED AFTER THE MANUFACTURED HOME HAS BEEN SECURED ON THE SITE. 3) A REGISTERED PROFESSIONAL CIVIL ENGINEER MUST CERTIFY THAT THE MANUFACTURED HOME HAS BEEN SECURELY ANCHORED TO THE SITE AND THAT THE INSTALLATION OF THE MANUFACTURED HOME MEETS THE REQUIREMENTS OF SECTION 26-9 OF THE FLOODPLAIN ORDINANCE. THE CERTIFICATION MUST BE RETURNED TO THE ENGINEERING SECTION OF DEVELOPMENT SERVICES BEFORE ANY OCCUPANTS ARE ALLOWED TO MOVE IN. 4) EXCEPT AS APPROVED BY THE CITY ENGINEER PRIOR TO THE START OF CONSTRUCTION, DEVELOPMENT UNDER THIS PERMIT SHALL NOT OBSTRUCT, RETARD OR DIVERT THE EXISTING FLOW OF FLOODWATERS FROM OR TO ADJACENT PROPERTIES. 5) THIS PERMIT BECOMES INVALID AND IS SUBJECT TO ADDITIONAL FLOODPLAIN REVIEW, IF ANY REQUIRED DEVELOPMENT PERMIT(S) CHANGES THE CONFIGURATION OF THE STRUCTURE AND OR SITE DEVELOPMENT. THIS FLOODPLAIN USE PERMIT WILL BE AUTOMATICALLY REVOKED AND BECOMES INVALID FOR NON-COMPLIANCE TO CONDITIONS SET FORTH IN THIS PERMIT. ALSO, THIS PERMIT WILL EXPIRE ONE YEAR FROM ITS DATE OF ISSUE. RENEWAL OF THIS PERMIT WILL REQUIRE A NEW APPLICATION, REVIEW AND APPROVAL OF THAT APPLICATION BY THE CITY OF TUCSON, DEVELOPMENT SERVICES DEPARTMENT, ENGINEERING SECTION. |
