02/08/2005 FLOODPLAIN USE PERMIT # T04OT02516 PROJECT ADDRESS: 1841 W. PROBASCO DRIVE PROPERTY OWNER'S NAME: TITO SALDANA The applicant is authorized to use a portion of the flood hazard area in the City of Tucson, Arizona, on the property described as PROBASCO LOTS 9 & 10 BLK 2, for the purpose of constructing a new home. The applicant agrees to comply with City of Tucson Floodplain and Erosion Hazard Management regulations, and is particularly bound by the conditions stated below. Violation of any of the conditions stated or referred to below, as determined by the City Engineer, shall be grounds for revocation of this permit. Responsibility for renewal of this permit, if necessary, is with the applicant. Issuance of this permit does not constitute a waiver of other requirements contained in the Tucson City Code, Land Use Code, or any other Federal, State, or local regulation. No use other than as permitted herein is allowed. Additional uses allowed under City of Tucson Floodplain and Erosion Hazard Management Regulations require a new application, approval, and issuance of an additional Floodplain Use Permit. The following conditions apply to this permit (Tucson Code, Section 26): 1) The lowest floor elevation of the new structure, all electrical equipment, and any machinery and associated equipment serving the home shall be placed upon a dirt, concrete, or similar type solid pad to a minimum elevation of 2426.0' above sea level, National Geodetic Vertical Datum (NGVD) 1929, in accordance with the Drainage Report prepared by SCE Corporation, signed/sealed on February 7, 2005. This elevation converts to 2428.25' NAVD 1988, per the referenced drainage report. Certification of the lowest floor elevation of the structure and all applicable machinery and equipment (furnaces, hot water heaters, heat pumps, air conditioners and their associated equipment - including all electrical equipment on an open utility platform that provide utility services for the building), shall be performed by a state-registered land surveyor on the enclosed elevation certificate. The elevation certificate must be fully completed, signed and certified upon completion of construction of the structure and all associated machinery and equipment, as discussed above. The completed elevation certificate must be returned to Engineering Division, Development Services Department, at the City/County Public Works building - 201 N. Stone Ave., 1st floor. A hold will be placed on the final inspection until a properly completed elevation certificate is returned to this office. 2) All work shall conform to the approved site plan (DSD activity # T05CM00436), grading plan (# T05BU01495) and applicable portions of the Drainage Report that are CONSISTENT WITH THE APPROVED SITE AND GRADING PLANS, which are made a part of this permit. 3) The existing drainage patterns at the property lines shall not be obstructed, other than as may be shown on the attached site plan and/or described in the Drainage Report. 4) Except as approved by the City Engineer prior to the start of construction, development under this permit shall not obstruct, retard or divert the existing flow of floodwaters from or to adjacent properties. 5) Within 5 (five) days of issuance of this permit, through completion of the project, notification must be posted and maintained in a conspicuous place on the job site stating "CONSTRUCTION PROCEEDING UNDER REQUIREMENTS OF CITY OF TUCSON FLOODPLAIN USE PERMIT # T04OT02516. FOR INFORMATION PLEASE CALL 791-5550." 6) A right-of-way permit is required for any development, excavation, or construction activity within the right of way. Contact Tucson Department of Transportation (TDOT) - Permits and Codes Section, Engineering Division at 791-5100 for questions relating to right of way permit information. 7) This permit becomes invalid and is subject to an additional floodplain permit application and review, if any proposed or required modifications change the configuration of the structure and/or site development. 8) Any walls to be proposed will require a separate floodplain use permit application, review and approval prior to construction. This Floodplain Use Permit will be automatically revoked and becomes invalid, if development onsite results in non-compliance with conditions set forth in this permit. This permit will expire one year from its date of issue. Renewal of this permit will require a new application, review, and approval by the City of Tucson, Development Services Department, Engineering Division. A hold will be placed on the CERTIFICATE OF OCCUPANCY until the properly completed elevation certificate is returned to this office.
