10/07/2005 Special Inspection Required The applicant is authorized to use a portion of the flood hazard area in the City of Tucson, Arizona, on the property described as: 1940 East Broadway Boulevard for the purpose of a demolishing an existing retail store, constructing a new retail store and associated site improvements. The applicant agrees to comply with City of Tucson Floodplain and Erosion Hazard, and are particularly bound by the conditions stated below. Violation of any of the conditions stated or referred to below, as determined by the City Engineer, shall be grounds for revocation of this permit. Responsibility for renewal of this permit, if necessary, is with the applicant. Issuance of this permit does not constitute a waiver of other requirements contained in the Tucson City Code, Land Use Code, or any other Federal, State, or local regulation. No use other than as permitted herein is allowed. Additional uses allowed under City of Tucson Floodplain and Erosion Hazard Regulations require the issuance of an additional Floodplain Use Permit. The following conditions shall apply to this permit. 1. All work shall conform to the improvement plans submitted as Activity T0BU01240 (Grading Permit) and Activity T04OT01039 (Site Plan) which is made part of this permit. An additional permit for the construction of the new retail store will also be incorporated into this permit. 2. If fill is required to raise the lowest floor, the buildings shall be placed on a engineered pad, compacted to 95% density, extending twenty-five (25) feet beyond the buildings foundation, unless a study prepared by a state-registered professional civil engineer and approved by the city engineer shows that a lesser distance is acceptable. 3. The lowest floor and all associated facilities of the buildings in the property under this permit shall be placed a minimum of 2441.41 feet above mean sea level, NGVD 1929 (as referenced in the Hydrology Report from Thomas Leon Lencycki, Dated June 30, 2005), as Certified by a Registered Land Surveyor. This certification must be completed and returned to the Development Services Dept., Engineering Section on the 1st. Floor of the County/City Public Works Building at 201 N. Stone Avenue. 4. The existing drainage patterns at the property lines shall not be obstructed. 5. Except as approved by the City Engineer prior to the start of construction, development under this permit shall not obstruct, retard or divert the existing flow of floodwaters from or to adjacent properties. 6. This permit becomes invalid and is subject to additional floodplain review, if any required development permit(s') changes the configuration of the structure and or site development. 8. The elevation certificate must be returned to the Development Services Department, Engineering Division, 201 N. Stone Ave. This Floodplain Use Permit will be automatically revoked and becomes invalid for non-compliance to conditions set forth in this permit. Also, this permit will expire one year from its date of issue. Renewal of this permit will require a new application, review and approval of that application by the City of Tucson, Development Services Department, Engineering Section. Note: Final inspection or certificate of occupancy will be on hold until the Elevation Certificate is completed and returned to our office. The applicant is authorized by the City Engineer to receive a floodplain use permit subject to the above referenced conditions and restrictions.
