The applicant's property is a 10,316 square foot site with a vacant 1,050 square foot building constructed as a two-bay automotive service station.The applicant is requesting the following variances; 1) delete the requirement for a future site plan showing code compliance with the future right-of-way, 2) delete onsite pedestrian facilities (walkways), 3) reduce the number of vehicle parking spaces from eighteen (18) to fourteen (14) and allow up to four spaces to be tandem spaces, 4) reduce the width of the Parking Area Access Lane (PAAL) from twenty four (24') feet to twenty-one feet six inches (21'6"), and 5) delete the street landscape border and screening along Mitchell Street.
DECISION: VARIANCES 1, 2, 3, 4 and 5: GRANTED WITH CONDITIONS:
A. A plan showing a new use of the property in conformance with all applicable codes shall be prepared and submitted to the City at the time the City declares its intention to acquire future right of way.
B. The granting of this variance does not determine whether the applicant could have continued the nonconforming use of the property in an economically viable manner or whether another economically viable permitted use can be developed on the property at the time of acquisition of future right of way.
C. Conditions A and B to be recorded in Pima County records.
