C10-04-30 | Efectuat | 01/06/2009 | N/A | LUCAPHST | C10-04-30 SILVERBELL RESIDENTIAL DEVELOPMENT (S04-188) The applicant's site is an undeveloped 31 acre parcel located along the east side of Silverbell Road just south of the entrance to the Silverbell Municipal Golf Course within the Scenic Corridor Overlay Zone. The applicant proposes a single-family residential development consisting of approximately 151 lots developed as a Residential Cluster Project (RCP), and is requesting the following variances to Scenic Corridor Overlay Zone requirements: 1) to allow construction of a new drainage channel within the thirty (30') foot natural buffer area; 2) to allow the import of 250,000 cubic yards of fill dirt to modify the existing onsite topography; 3) to allow the import of 250,000 cubic yards of fill dirt and modify the natural drainage now existing onsite; and, 4) to allow a project slope greater than one (1') foot rise or fall over a three (3') foot length, as shown on the submitted plan. DECISION: Variances 1, 2, 3, and 4: Granted subject to the following conditions: [The following conditions were taken from Estes Development Co. letter dated August 24, 2004 and submitted to the Board as part of its variance request] A. Reduce the number of lots from 151 to 143. B. The Estes Development Co. at its own expense, will design to City standards with City [Engineering] approval and build (during the project construction) left hand turn lanes for the two streets that intersect Silverbell Road on the west boundary of the proposed development. C. Prior to final approval of the subdivision plat, Estes Development Co. will submit the proposed landscape plan [ along Silverbell Road ] to the Design Review Board (DRB) for its review and approval. D. Prior to final approval of the subdivision plat, Estes Development Co. and its engineers will demonstrate to the City staff that it has minimized the amount of disturbance created by the drainage channel in the thirty (30) foot Scenic Corridor buffer area and has minimized the amount of rip-rap or other structural work in view of the roadway. [The following conditions were added by the Board] E. The Silverbell Road landscape plan (submitted to the DRB) to include the reestablishment of native vegetation, by seeding and/or by transplant, in the thirty (30) foot wide Scenic Corridor buffer area. The vegetation in the buffer area to reflect, as much as is possible, the vegetation naturally occurring along Silverbell Road F. Variances to be effectuated upon issuance of a grading permit. G. Residences adjacent to Silverbell Road be limited to one-story. H. Provide up to a ten (10) foot wide natural vegetative buffer area along that portion of the Silverbell Road right-of-way in front of the north drainage channel. The final widths of this buffer area to be determined by City Engineer approval. I. If the Archaeological Study allows, provide additional lots in the area adjacent to Lots 89-101 and decrease correspondingly the number of lots in the area between Lots 133-143. |
