OWNER CLAIMS THAT HE PUT THIS WORDING ON LEASE SO THAT TENANTS COULD GET THEIR ELECTRICITY CHEAPER WITHOUT PAYING A LARGE DEPOSIT TO TEP. HE ALSO STATES THAT RESIDENTIAL WORDING WAS TO KEEP TENANTS FROM USING SPACE FOR HEAVY COMMERCIAL USE. OWNER DID PROVIDE A COPY OF HIS NORMAL RESIDENTIAL LEASE CONTRACT AND HAS NOTHING IN COMMON WITH THE COMMERCIAL/RESIDENTIAL CONTRACT SIGNED BETWEEN HIM AND TENANTS. OWNER ALSO SEEMED SINCERE IN NOT HAVING RENTED SPACE OUT AS LIVING QUARTERS. TENANTS SEEM EQUALLY SINCERE IN THEIR CLAIM THAT SPACE WAS RENTED AS LIVING QUARTERS. BUILDING REMAINS CONDEMNED AS LIVING SPACE BUT COULD POSSIBLY BE USED AS COMMERCIAL SPACE. AN ELECTRICAL INSPECTION WILL BE DONE TO DETERMINE IF WIRING IS OK FOR COMMERCIAL USE. | |
