The structure on the east side of the home is not attached to the dwelling and does not require permits based upon that condition; however the size of the structure was not verified and may require permits based upon the size of the structure if it exceeds 200 square feet. -VM

03/07/2023 COT - ENFC - Code Enforcement - Follow Up In Violation 956 AM - Responded to site due to being assigned prosecution for the existing Code Enforcement Case. Owner was standing outside upon my arrival. I spoke with owner who allowed me to look at the garage structure and storage building on the west side of the home as well as a shade structure on the east side of the home. Both the garage and storage building on the west side are attached to the structure and have electrical installed. The garage does not have a foundation and has bare gravel/dirt as the floor. There is a DDO signed from the neighbor to the west. I did make contact with that neighbor and she expressed no concerns with the structures. The homeowner has applied for permits however did not respond when corrections were required. -VM

06/13/2023 COT - ENFC - Code Enforcement - Follow Up In Violation 1000 AM - Hearing was held, and defendant was present. Defendant reports he is working through the permit process but doesn't feel the questions PDSD are asking of him are appropriate, as he is not building a nuclear facility, just a storage area. Asked the court for a 6 month continuance. City objects to a 6 month continuance. City asserts that PDSD are the experts in Building Safety and the questions are necessary as the structures are attached to the main structure, have reduced or no setbacks which pose a certain level of hazard, and have electrical. City reports the Defendant is not taking this seriously and may need to hire a professional if he is unable to complete the drawings as required, or ultimately remove the structures, and further, requests made from him to not post pictures of the structure online cause the City to question his intent. Judge issued a 4 month continuance, hearing set for October 10 2023. -VM

10/10/2023 COT - ENFC - Code Enforcement - Follow Up In Violation 1000 AM - Hearing was held and defendant was present. City asks for a plea or the need to conduct a hearing to obtain a judgement on the charges as the citation was issued October 25, 2022 and it has been almost a year. Defendant pleads responsible. City asks for minimum fines to be imposed as Defendant has made progress but in a very slow manner. City suggests it may be necessary for Defendant to hire a draftsman or architect to draw his plans if he is unable to do so. Judge suspends fines, issues continuance until January 16, 2024 at 930 AM. -VM
