1) UDC:
A) change of copy acceptable for this nonconforming pole sign, same use - as flat vinyl panels will not extend beyond the sign cabinets and all light will be contained behind the vinyl faces.
B) update sheet 2 to indicate the work is on freestanding sign (side diagram notes wall cabinets)

2) NEC: new LED light pack:
A) indicate where dedicated circuit / breaker panel is for service / inspection
B) provide lock out on disconnect switch at breaker panel for save sign service

3) OLC:
A) Per Chapter 501.6. curfew for signs is to be turned off at midnight or when business activities cease, whichever is later. Provide time of curfew on the plans for the timer.
B) Note what type of timer, i.e. digital or standard, and note location for inspection.

Applicant submitted revised plans 2/24/22, showing bottom cabinet with the flat face. The top cabinet, however, remains shown with 3" raised lettering with LED lighting enclosed behind acrylic faces. This lettering protrudes off the surface of the sign panel.
The subject pole sign is a nonconforming sign (for the premise to have a pole sign, and for pole sign height, setback and sign area criteria). A nonconforming sign is regulated by Section 7A.9.1. of the Unified Development Code (UDC) and 7A.4.1.A.5 permit compliance with technical codes.
UDC Section 7A.9.1.c. states, "Except for reasonable repairs and alterations, no nonconforming sign shall be moved, altered, removed and reinstalled, or replaced, unless it is brought into compliance with the requirements of the sign standards. The updating of electrical components for a non-conforming sign may be considered an approved alteration. The alteration cannot change the sign copy from static sign copy to digital sign copy.
The proposal as shown for the top cabinet is not like for like for prior material on this sign, as there were no channel letters on the sign prior. The original exposed neon tubing on the sign face was removed and cannot be replaced on this sign, as that neon was nonconforming to the Outdoor Lighting Code.
To come into compliance:
1) The nonconforming pole sign may be removed and a code compliant monument sign installed via permit review process,
OR
2) A change of copy and repair permit application may be processed that shows static light source(s) fully enclosed within the existing extents of both sign cabinets and behind flat surfaced panels. Specifically, plans must show the removal of the raised lettering on all parts of the sign cabinetry and providing only flat panels to the sign cabinets, with lighting totally enclosed within those sign cabinets behind the sign panels.

Applicant submitted revised plans 11/18/21, showing same raised lettering on both cabinets, this time rather than 5" protrusion, now at only 3" raised protrusion and enclosed behind clear acrylic faces.

The subject pole sign is a nonconforming sign, and as such, is regulated by Section 7A.9.1. of the Unified Development Code (UDC) and also 7A.4.1.A.5 permit compliance with technical codes.

UDC Section 7A.9.1.c. states, "Except for reasonable repairs and alterations, no nonconforming sign shall be moved, altered, removed and reinstalled, or replaced, unless it is brought into compliance with the requirements of the sign standards..."

A permit cannot be issued for the work done to this sign, nor to the proposed work as shown in the 11/18/21 plan set - as the alterations are not reasonable for the following reasons:

expanded surface volume (thickness) by adding raised lettering to a prior flat cabinet surface

addition of exposed lighting noncompliant with all applicable sections of the Outdoor Lighting Code (OLC)

To come into compliance, the pole sign structure may either be removed and a code compliant sign installed via permit review process, OR a change of copy and repair permit application may be processed that shows static light source(s) fully enclosed within the existing extents of the sign cabinets and behind flat surfaced panels. The plans submitted for the permit must show compliance with all applicable city technical codes.
