07/14/2022 INSP - FOLLOW UP CODE ENFORCE Approved ONSITE INSPECTION RESULTS: THE NIGHT CLUB ACTIVITY WAS IDENTIFIED AS TO A STAGE WITH A DJ AND LIVE MUSIC. THERE IS DANCE FLOOR AREA WHICH HAD GUESTS. THERE IS ADVERTISEMENT ON SOCIAL MEDIA FOR 'NIGHT CLUB' ENTERTAINMENT EVERY THURSDAY AT THIS LOCATION. THERE IS ALSO A PLANNED EVENT SCHEDULED FOR JULY 22, 2022, THE EVENTS NAME IS TO HIP-HOP COMPETITION.
THE NIGHT CLUB OR DANCE HALL ACTIVITY IS NOT AN APPROVED USE. THE LAST CERTIFICATE OF OCCUPANCY STATES RESTAURANT ONLY. THERE IS HISTORY OF COMMUNICATION FROM CODE ENFORCEMENT AS TO THIS USE BEING PROHIBITED. A NOTICE OF VIOLATION WAS ALSO ISSUED BY CODE ENFORCEMENT ON JAN 2022 FOR THE ABOVE PROHIBITED USE.
OVERALL: THIS NIGHT CLUB USE CONTINUES AND THERE IS ADVERTISEMENT FOR A PAY TO DANCE EVENTS OPEN TO THE PUBLIC. I BELIEVE THIS WOULD BE CLASSIFIED AS A DANCE HALL TYPE OF ASSEMBLY. A STOP WORK ORDER WAS ISSUED AND A PLACARD WAS POSTED ON THE BUILDING.
THE VIOLATION IS OPERATING A OUTSIDE THE BOUNDARIES OF THE LAST APPROVED CERTIFICATE OF OCCUPANCY WHICH IS FOR (RESTAURANT USE ONLY) THE ORDER ALSO STATES THE IF THE STOP WORK ORDER IS VIOLATED THEN THE CURRENT C OF O MAY BE BE REVOKED AND THE BUILDING WILL BE CONDEMNED. A CITATION WILL ALSO BE ISSUED.
A FOLLOW UP INSPECTION IS SCHEDULED FOR THURSDAY THE 21ST OF JULY.
04/21/2022 INSP - FOLLOW UP CODE ENFORCE Approved I did contact the manager Melinda who stated they rented the space that includes the dance area and were allowed to use as such per her attorney and zoning. She also mentioned speaking with Georgina regarding this issue. I advised that the C-2 zone does not allow a dance hall and the last approved C of O does not mention dance hall, only a restaurant. She seemed very adamant to continue the use. So I'm thinking violations UDC 10.2.3, change without zoning review, UDC Table 4.8-4 Dance hall use specific standards at 4.9.4.c.3, dance halls prohibited.
01/05/2022 INSP - FOLLOW UP CODE ENFORCE Approved Did the N.O.V. and went to the site to serve the manager of the restaurant on the music and the dance floor needs to be closed. The manager did sign the N.O.V. and gave her 2-copies of the N.O.V. Did talk to Martin Romero the supervisor and showed the N.O.V. and was advised that Rick Mendoza will be checking the site once I go on leave. RV.
12/18/2021 INSP - FOLLOW UP CODE ENFORCE Approved Did a follow up inspection with T.F.D. on checking the exiting and the exit lights, sprinkler system and not able to find the riser pipe and controls due to in another building. Does have some electrical issues and T.F.D. will be meeting on Tuesday to go over the issues on the site. Did have to lower the music and was advised to be below 75 decibels and was checked with the DJ's on the phone and was below 75 decibles at the time of the reading. They were advised that if called back will be closing the music down. Did go over that they will need to meet with zoning if want to continue with the music. Did go over that the food was not being served and only alcohol was only being served. Will be checking with zoning if the music can be played on the property due to the closeness to the residential neighborhood. T.F.D. not doing anything on the hookahs at this time due to not being used and were just on the shelf. The manager was cooperating with the inspection and wants to do what is right to continue what she is doing. RV.
