KNOCKED ON DOOR OF #6, OCCUPANT STATED HE HAS LIVED THERE FOR 6 MONTHS, HAS HAD NO PROBLEMS AND WOULD RATHER NOT ALLOW ENTRY BECAUSE OF THE NATURE OF THE COMPLAINT. FOUND #15 TO BE VACANT BUT SECURED, 2ND STORY UNIT WAS HAVING WINDOW REPLACED, BUT NOT AN ISSUE BEINGIT WAS ON THE 2ND FLOOR AND WINDOW OPENED UP TO A ROOF AREA.
I THEN MET WITH THE COMPLAINTANT WHO STATED HIS MAJOR COMPLAINT WAS ASBESTOS, I EXPLAINED WE DID NOT INSPECT FOR ASBESTOS, HE STATED THAT HE WAS TRYING TO GET OUT OF LEASE BECAUSE OF THE ASBESTOS ISSUE. THAT A NEIGHBOR WAS HELPING HIM GET A ASBESTOS REPORT AT WHICH TIME HE COULD PROVE OWNERS ARE DOING ADDITIONAL WORK TO THE UNITS. I STATED THAT I MAY HAVE TO WAIT UNTIL THE REPORT IS OBTAINED.
I THEN WALKED UP FOUND 15 VACANT BUT SECURED, COMPLAINTANT LIVED IN #14, THERE WAS NO WORK BEING COMPLETED, AND I LOOKED INTO 13 WHERE UIT WAS VACANT AND SECURED AND UNIT WAS BEING USED FOR STORAGE, I FOUND ONLY TOOLS, SHOP VACS, PAINTING STUFF, LANDSCAPE TOOLS AND IT APPEARRED UNIT WAS BEING WORKED ON AND GETTING READY TO REOCCUPPY. I ASKED OCCUPANT TO CONTACT THE DEPARTMENT WHEN HE RECEIVED HIS ASBESTOS REPORT.
I CALLED AND SPOKE WITH DIANNA CRUZ OF HALLMARK REALTY, PROPERTY MANAGERS WHO WERE AWARE OF THE COMPLAINT, BECAUSE THE OCCUPANT IS A VETERAN, AND BECAUSE THE UNITS ON EITHER SIDE ARE HAVING WORK COMPLETED TO REOCCUPY UNITS, MANAGEMENT DECIDED TO ALLOW HIM OUT OF HIS LEASE WHICH IS WHAT HE WANTED. THE MANAGERS ARE UNAWARE OF ANY KNOWN ASBESTOS. MANAGEMENT DID THINK HE WAS ALREADY OUT OF THE UNIT, AND STATED THEY WILL CONTACT HIM TO FIND OUT WHERE HE IS OUT WITH MOVING AS HE WAS SUPPOSE TO BE OUT BY THE 31ST OF DEC. DIANNA STATED THEY WOULD CALL ME BACK. BECAUSE UNITS ARE BEING REOCCUPIED C/E WILL HAVE NO JURISDICTION. C/E SUPERVISOR STATED WE WOULD CLOSE OUR CASE AND REOPEN IF REQUIRED DUE TO THE MAIN ISSUE OF ASBESTOS WHICH WE DO NOT INSPECT FOR. NO VIOLATIONS AT THIS TIME, COMPLIANCE / CLOSE CASE.
