11/27/2017 | INSP - FOLLOW UP CODE ENFORCE | Approved | EMAIL FROM CITY ATTORNEY REGARDING JURISDICTION ON REGULATING SHORT TERM ACCOMODATIONS: From: Christopher Avery To: Rick Mendoza CC: Piroschka Glinsky Date: 11/22/2017 1:53 PM Subject: Re: Short term rental. 10153 E. Queensgate Wy Rick: We met and looked things over and think that the new Arizona law, 9-500.39, only allows the City to regulate "traveler's accomodations" on the basis of public health and safety ordinances and noise/nuisance ordinances that also apply to all other commercial or residential propert, which means that we don't have the authority to regulate 10153 E. Queensgate solely for the violation of running a traveler's accomodation. Chris. >>> Rick Mendoza 11/16/2017 1:32 PM >>> Perfect. Thank you. Rick Mendoza Code Enforcement Inspector City of Tucson Environmental and General Services Phone (520) 631-3799 >>> Christopher Avery 11/16/2017 12:24 PM >>> Rick: The reason you haven't gotten an answer from me is that we have a legal issue between Arizona statutes that we have to talk over internally and figure out. I don't have a quick answer for you, in the mean time please hold off on any enforcement action. Thanks, Chris. |
