I ASKED IF HE WOULD ALLOW ME TO ENTER TO INSPECT THE SHOWER, HE DID ALLOW ENTRY. I FOUND THE SHOWER WAS COMPLETED, THE PLUMBING FIXTURES HAD BEEN INSTALLED AND COMPLETED, ALL TILE COMPLETED, AND ALL DRYWALL PATCHED TAPED AND TEXTURED. I ASKED THE OCCUPANT IF THEY WERE HAVING ANY PROBLEMS WITH THE SHOWER, HE SAID THEY WERE NOT. THE SON ALSO STATED THAT THE MAINTANENCE PERSON HAD REMOVED THE SUPPLY AIR GRILLE IN THE BATHROOM, SCRAPED THE SUPPLY AIR DUCTWORK, IS NOW RETEXTURING THE DRYWALL SURROUNDING THE SUPPLY DUCT AND WILL REPLACE THE SUPPLY GRILLE. SHOWER IS COMPLETED, A JOB WELL DONE AND OWNER/ MAINTANENCE HAS GONE ABOVE TO MAKE THINGS RIGHT IN THE BATHROOM. **SPOKE WITH MAINTANENCE PERSON WHO ASKED IF THE SHOWER WAS OK, I TOLD HIM I THOUGHT HE DID A VERY NICE JOB AND THANKED HIM FOR RETEXTURING THE CEILING. COMPLIANCE/ CLOSE CASE. |

| 11/10/2015 | INSP - INITIAL CODE ENFORCMENT | Approved | REVISITED SITE, SPOKE WITH MAINTANENCE PERSON WHO STATED AS FAR AS HE KNEW THE TENANTS WERE BEING EVICTED, MANAGER AMANDA WAS LEAVING AND IN THE PROCESS OF TRAINING NEW MANAGER APRIL AND NEITHER WERE NOT ON SITE AT THE TIME. I SPOKE TO THE SONS OF TENNANT INEZ AFTER RECEIVEING A CALL FROM INEZ, THE REASON FOR MY INSPECTION. I TRIED TO EXPLAIN TO THEM THAT THE OWNER WOULD BE EVICTING THEM AGAIN DUE TO LACK OF PAYMENT AND THAT THE ONLY PERSON ON THE LEASE WAS THEIR MOTHER AND THEIR LEASE WAS MONTH TO MONTH, AND THE FACT THAT THEY WERE NOT ALLOWING ENTRY FOR WORK TO BE COMPLAETED ON THE SHOWER, MAKING IT DIFFICULT FOR ME TO MOVE FORWARD WITH MY CASE. I ALSO EXPLAINED THAT THEIR STORY OF NOT ALLOWING OWNER IN TO MAKE REPAIRS DOES NOT MATCH THE STORY OF THE OWNER, AND THAT I WOULD NEED TO TALK TO MY SUPERVISOR BEFORE MOVING FORWARD. DID SPEAK WITH RICK SALDATE AND WENT OVER THE ENTIRE CASE THAT TENNANTS WERE EVICTED, ALLOWED TO STAY AFTER PAYING RENT. WENT OVER OWNERS SIDE OF THE STORY AND NOT BEING ALLOWED INSIDE TO COMPLETE THE WORK. MENTIONED THE MONTH TO MONTH LEASE AND NO SIGNED LEASE AGREEMENT, INCLUDED NON PAYMENT OF RENT AGAIN AND 5 DAY NOTICE TO EVICT A SECOND TIME. RICK STATED I WOULD NEED TO EXTEND TIME TO THE OWNER TO ALLOW HIM TO GAIN ENTRY AND MAKE THE REPAIRS OR WAIT AND SEE HOW THE EVICTION PROCESS PLAYS OUT. I DID SPEAK WITH MANAGER APRIL AND AS OF FRIDAY THE TENNANTS DID NOT ACCEPT CERTIFIED MAIL, THEREFORE APRIL WILL BE CONTACTING THE LAWYER THIS WEEK TO DETERMINE HOW THEY WILL MOVE FORWARD. I HAVE EXTENDED TIME TO MAKE REPAIRS UNTIL 12/07/15 OR TO DETERMINE HOW THE EVICTION PROCESS PLAYS OUT. DID TRY TO CONTACT THE OWNER, DID LEAVE MESSAGE WITH THE EXTENSION INFORMATION. ALSO CONTACTED APRIL AND GAVE THE INFORMATION OF THE EXTENSION. |

NOTICE WAS ISSUED ON 10/6 AND SENT TO LAWYER ON 10/20. EVICTION LETTER WAS SENT CERTIFIED. MET WITH OCCUPANT JOSHUA WHO STATED THE MANAGER STARTED DEMOLITION ON THE SHOWER DUE TO TILE FALLING ON HER MOTHER WHILE IN THE SHOWER. JOSHUA STATED MANAGEMENT STARTED WORK 2-21/2 WEEKS AGO BUT WAS NOT GETTING THE JOB COMPLETED. OCCUPANTS SON HELPED INSTALL A TUB SURROUND, SHOWER HEAD AND VALVE AND HAS BEEN WAITING FOR MANAGEMENT TO COME IN AND COMPLETE THE TILE BUT STILL IS NOT DONE. AMANDA STATED SHE THOUGHT SON WAS GOING TO COMPLETE THE JOB. I EXPLAINED TO AMANDA SHE WOULD BE ISSUED A NOV TO COMPLETE THE SHOWER EVEN THOUGH THE EVICTION HAS BEEN STARTED. I DID SPEAK WITH THE OCUPANT AND SHE SAID SHE RECEIVED ONLY A HAND WRITTEN EVICTION. I TRIED TO EXPLAIN WHY SHE SHOULD NOT HOLD BACK RENT FOR THE UNCOMPLETED WORK AD EXPLAINED NOV WOULD BE ISSUED AND HAND DELIVERED. SPOKE WITH OWNER (10/21/2015) OWNER WAS IN TOWN,IS AWARE OF THE COMPLAINT AND THE ENTIRE SITUATION. MENTIONED HE WOULD GET TILE COMPLETED AND WOULD STILL BE FOLLOWING THRU WITH THE EVICTION PROCESS. |
