RE: Fire Inspection

Dear Mrs Garrison

The Tucson Fire Department has conducted a fire safety inspections at the above stated business on November 19, 2009. At that time a notice was issued indicating the corrections required to provide compliance with the applicable codes, regulations and ordinances. Subsequent re-inspections were also conducted on December 3, 2009, December 10, 2009 and December 17, 2009. We were unable to gain voluntary compliance.

Compliance is required by the 2006 International Fire Code with Modifications

1008.1.9 Panic and fire exit hardware. Where panic and fire exit hardware is installed, it shall comply with the following: …

Each door in a means of egress from a Group A or E occupancy having an occupant load of 50 or more…shall not be provided with a latch or lock unless it is panic hardware or fire exit hardware.

Currently your rear exit (South) has both the required panic hardware AND a thumb-latch deadbolt installed which can not be used in conjunction with panic hardware. This is a distinct life safety hazard.

Required Action: Remove the thumb-latch deadbolt from the South exit door.

This letter is to inform you that if the above stated necessary corrections have not been completed by January 4, 2009 a citation will be issued which will require an appearance by you in court with a probable fine. This letter is written as a courtesy to you in order to avoid future litigation.

12/14/2009 INSP - FULL Correction Required Upon re-inspection on December 10, 2009 the exiting issue had not been abated.

A re-inspection has been scheduled for December 17, 2009
12/03/2009 INSP - FULL Correction Required UPON RE-INSPECTION ALL ITEMS WHERE ABATED EXCEPT THE REAR DOOR, WHICH WAS PROVIDED WITH PANIC HARDWARE, ALSO HAD A THUMB LATCH.

11/23/2009 INSP - FULL Correction Required IFC 2006

605.5 Extension cords. Extension cords and flexible cords
shall not be a substitute for permanent wiring. Extension cords
and flexible cords shall not be affixed to structures, extended
through walls, ceilings or floors, or under doors or floor coverings,
nor shall such cords be subject to environmental damage
or physical impact. Extension cords shall be used only with
portable appliances.

Currently there is an extension cord extending through the ceiling powering the Big sceen T.V. on the North wall.

Requires Action: Remove the extension cord and do not use extention cords as a substitute for permanent wiring.

3003.5.3 Securing compressed gas containers, cylinders
and tanks. Compressed gas containers, cylinders and tanks
shall be secured to prevent falling caused by contact, vibration
or seismic activity.

Currently the commpresed gas sylinders ni teh kitchen are not all secured.

Required Action: Secure all compressed gas cylinders.

Currently the rear exit door has a handle and a thumb-latch dead bolt. Also the occupant load card show an OL of 98 persons.

Required Action: Provide panic hardware on the rear door . It shall be the only locking device on the door.

REINSPECTION
I will return on or about December 3, 2009 for a re-inspection.
