| 03/12/2009 | INSP - FOLLOW UP CODE ENFORCE | Approved | March 12, 2008 Jim Stagner 2019 North Bell Avenue Tucson, AZ 85712 RE: 2019 North Bell Avenue, R-2; Illegal Trailer DSD Activity/CSD Violation No.: T08DV10508 Land Use Code (LUC) Information Dear Mr. Stagner, Thank you for meeting with Mr. Duarte, Mr. Kafka and I on March 3, 2009. The additional information you provided and questions you presented was sufficient to allow for a new review of the issue, but insufficient to change the previous determination. Based on this subsequent review, the Zoning Administrator's determination remains that the subject trailer is not "manufactured housing" as defined by LUC Sec. 6.2.13, is not a "recreational vehicle" as defined by LUC Sec. 6.2.18, and is not, for zoning purposes, considered typical customary "residential storage", it is not permitted in the R-2 zone. The unit does however meet the definition of "mobile home" as defined by LUC section 6.2.13 and would be allowed in any MH zone or previously established non-conforming mobile home space. Please note, this determination by the Zoning Administrator is appealable to the Board of Adjustment provided the appeal is made in writing and filed with the City's Development Services Department, 2nd Floor, 201 North Stone Avenue, along with the appropriate appeal fees, within thirty (30) days of the date of this letter. Information on the fees and documentation necessary to finalize an appeal to the Board of Adjustment can be obtained by contacting Russlyn Wells of DSD at (520) 837-4946 or by email at russlyn.wells@tucsonaz.gov. If you have any questions concerning this zoning determination, please don't hesitate to contact me at (520) 837-4946 or William Balak at (520) 837-4952. Sincerely, Craig L. Gross Zoning Administrator Development Services Department s. zoning administration/zoning/2009/2019 n bell trailer.doc Attachments: LUC Secs. 6.2.13 and 6.2.18. LUC Section 6.2.13 Definitions - M: Manufactured Housing. A multisectional mobile home dwelling manufactured after June 15, 1976, to standards established by the U. S. Department of Housing and Urban Development which has external dimensions of at least twenty-four (24) feet by forty (40) feet and is installed on a permanent foundation. A manufactured housing unit is considered equivalent to a single-family dwelling. A wall shall be installed continuously, except for ventilation and access, along the entire perimeter of the unit between the unit and the ground to give it the appearance of a site-built house. The wall shall be of masonry construction or similar material. The tongue, axles, transporting lights, and towing apparatus shall be removed before occupancy. (Ord. No. 9138, ยง1, 10/5/98) Mobile Home. A nonmotorized dwelling, transportable in one or more sections, constructed on a permanent chassis with wheels, suitable for year-round residential occupancy and requiring the same method of water supply, waste disposal, and electrical service as a site-built dwelling. Mobile home does not mean a recreational vehicle. LUC Section 6.2.18 Definitions - R: Recreational Vehicle (R.V.). A unit designed to provide travelers' accommodations built into, as an integral part of, or attached to a self-propelled motor vehicle chassis or drawn by a motor vehicle. The unit contains permanently installed independent support systems which provide at least four (4) of the following facilities: cooking, refrigerator or ice box, self-contained toilet, heating, air conditioning, a portable water supply system including a faucet and sink, a separate 110-125 volt electrical power supply, or an LP gas supply. |

| 11/19/2008 | INSP - FOLLOW UP CODE ENFORCE | Approved | Met with the owner and he provided us with this letter which is an appeal - it's attached. He said that he believes we are incorrect in our interpretation - that he does not have a single wide but it is a travel trailer. I told him that we would submit this to the zoning section for an interpretation. If it is found that our NOV is correct, he then would like to appeal. Request meeting with Zoning Staff Due to appeal request citation was put on hold |
