ONCE FINISHED WITH THE FIRST FLOOR OF INSPECTION ON BUILDING ONE THE INSPECTION WAS STOPPED DUE TO THAT'S THE ONLY BUILDING COMPLETED ON THE DOORS. IT WAS CONFIRMED THAT ALL WORK FOR T.F.D. WAS GONG TO BE DONE FIRST THAN TO WO0RK THE OTHER ISSUES ONCE AN INSPECTION IS DONE ON THE OTHER UNITS. IT WAS SAID THAT T.F.D. WILL BE GOING THRU ALL UNITS ON NOV. 30, 2005 AND WILL BE SPLITTING UP INTO TWO TEAMS. WILL CHECK WITH GERALD AND RICK IF WE ARE GOING TO BE PART OF THIS INSPECTION. WILL CHECK IN 20 DAYS. | |

AND FROM THE ROAD SAW THAT A UNIT ON THE BOTTOM FLOOR OF BUILDING 4 HAD BEEN BROKEN INTO. WENT DIRECTLY TO MANAGEMENT, ASKED LINDA ROSALES IF SHE WAS AWARE OF THE BREACH. SHE SAID SHE WAS, ALSO HAD ANOTHER UNIT 2103, AND THE LAUNDRY ROOM HAD BEEN KICKED IN. RECEIVED FROM MS ROSALES LISTS OF BOARDED UNITS, OCCUPIED UNITS, AND INCCIDENT REPORT FROM THE LAUNDRY ROOM AND A LETTER FROM THE POLICE CONCERNING THE AMOUNT OF CRIME DOWN IN THE AREA. INSPECTORS C-16 AND C-17 WALKED THE PROPERTY WITH LINDA ROSALES, VIEWED THE PROGRESS OF WORK TO THE COMPLEX.FOUND ELECTRICAL ON THE EXTERIOR OF THE PROPERTY GROUNDS HAD BEEN REPAIRED. ELECTRICAL SERVICE PANEL ON BUILDING 2 HAD BEEN REPAIRED AND COVERS REPLACED. COVERS ON ALL SERVICE PANELS HAD BEEN SECURED. WALKED BUILDING TWO UNIT 2103 WHERE A LEAK HAD BEEN FOUND (LEAKING FROM 2203). DRYWALL CARPET, INSULATION, HAD BEEN REMOVED FROM 2103, 2203 WAS MUCH THE SAME AS WATER WAS CONTINUALLY LEAKING FROM BATH LAVE IN 2203. DRYWALL IN HALLWAY HAD ALSO BEEN CUT,REMOVED AND REPLACED. DETERIORATING DRYWALL ON THE UNDERSIDE OF WALKWAYS HAD BEEN REMOVED,REPLACED AND RE-TEXTURED. HOLES IN STUCCO THROUGHOUT THE COMPLEX HAD BEEN STABILIZED WITH WOOD BACKING AND PATCHED. NEW METAL FRONT DOORS FOR UNITS HAD ARRIVED AND WERE STARTING TO BE PLACED IN THE UNITS WHERE NECCESARY. BIDS ARE BEING RECEIVED FOR PAINTING THE EXTERIOR. LANSCAPING HAS BEEN ADDRESSED AS WELL AS THE DRIP SYSTEM.PLUMBERS HAVE BEEN CALLED TO ADDRESS THE LEAKING HOSE BIBS. AND THE FIRE ISSUES ARE STILL BEING TAKEN CARE OF AT THIS TIME. ATER INSPECTING THE PROPERTY DNR INSPECTORS RECEIVED A CALL FROM LANNY COLTON WHO ASKED WHY WE WERE ON THE PROPERTY WHEN TIME HAD BEEN EXTENDED TO HIM FROM THE CITY, EXPLAINED WE FOUND BREACHED UNIT AND BECAUSE THE COMPLEX HAS BEEN AND ISSUE WE WOULD PROBABLY OUT PERIODICALLY TO CHECK THE PROGRESS WITHOUT HIS BLESSING TO BE ON THE PROPERTY. |

GIOIA FELT DNR NEEDED TO INSPECT THE EXTERIOR OF PROPERTY AND DETERMINE IF AN NOV NEEDED TO BE ISSUE FOR VIOLATIONS NOT COVERED BY FIRE. FIRE HAD INCLUDED IN THEIR NOV ISSUES THAT WOULD NORMALLY BE COVERED BY DNR. AFTER VISITING THE SITE AND WALKING THE PROPERTY , ALL THREE INSPECTORS AGREED THAT THE PROPERTY WAS IN FAIRLY GOOD CONDITION. HOWEVER PORCHES AND BALCONIES WERE FOUND TO BE IN A DETERIORATING STATE. WILL BE ACCESSED FURTHER. A/C UNITS ON THE ROOF WILL ALSO NEED TO BE ADDRESSED DUE TO COMMENTS FROM FIRE THAT UNITS WERE SETTING ON TIRES AND NOBODY HAS YET BEEN ON THE ROOF. DNR HAD NO LADDERS TO GET TO ROOF AREA AT THIS TIME. MET WITH MANAGER LINDA ROSALES WHO MENTIONED THAT TPD HAD BEEN OUT AND REQUESTED THAT UNIT 2206 BE SECUREDAS THEY HAD FOUND UNIT UNSECURED AS TPD WAS AN A CALL FOR THAT UNIT ON 9/13/05. OBTAINED COPIES FROM OFFICE FOR COMPLETED WORK FOR ELEVATOR UNITS- KONE INC. CACTUS SECURITIES, AND CINTAS FIRE PROTECTION. COPIES OF WORK ORDERS WILL BE IN CASE PACKET. |

ALL EXIT SIGNS ARE BEING REPAIRED ALSO. TALKED WITH JIM OF CINTAS FIRE COMP. WHO METIONED HE HAD BEEN WITH COMPANY FOR 16 YRS AND CONFIRMED THAT WORK WAS BEING DONE. ALSO MENTIONED FIRE INSPECTION WOULD BE DONE BY THEIR COMPANY. RECEIVED CALL FROM LANNY COLTON AT THIS TIME TO INFORM ME THAT HE HAD COME TO AND AGREEMENT WITH BILL HARBISON (BOARD UP CONTRACTOR) AND HARBISON WAS HIRE TO REPLACE ALL THE FIRE DOORS, WILL BE OUT TODAY TO BEGIN A TAKE OFF FOR THE MATERIALS NEEDED AND IS EXPECTED TO START ON THURSDAY. ALSO MENTIONED THAT A SECURITY COMPANY ALSO HAS BEEN OBTAINED TO BE ON SITE FROM 9PM TO 5 AM STARTING TONIGHT 9/13/05. JIM OF CINTAS MENTIONED HE WOULD NEED ACCESS TO ALL OCCUPIED UNITS, LINDA ROSALES MENTIONED THAT A 48 HR "LETTER TO ENTER" WILL BE POSTED ON ALL UNITS. COPY OF LETTER WILL BE PLACED IN CASE FILE. BUILDINGS WERE WALKED AGAIN TODAY AND FOUND THAT THE 3 UNITS FROM YESTERDAY HAD BEEN SECURED. | |

FIRST WALKED THE EXTERIOR OF PROPERTY SHOWING THEM VIOLATIONS THAT WERE ISSUED BY FIRE. EXPLAINED THAT DNR HAD NOT YET ISSUED ANY NOV FOR THE EXTERIOR OF PROPERTY, AT THIS TIME MOST ISSUES WERE BEING COVERED BY FIRE. WHILE WALKING THE INTERIOR OF THE FIRST BUILDING, FOUND A UNIT ON THE 3RD FLOOR WHICH HAD BEEN KICKED IN AND WAS UNSECURED AT THIS TIME. TOOK MR COLTON AND MRS. ROSALES INSIDE THE UNIT AND EXLAINED THAT THE TRASH AND DEBRIS INSIDE THE UNIT WAS TYPICAL OF MOST OF THE SECURED UNITS AT THIS TIME. PHYSICALLY SHOWED MR COLTON WHAT DNR WOULD BE EXPECTING OF HIS COMPANY TO BRING EACH AND EVERY UNIT INTO COMPLIANCE PRIOR TO REOCCUPYING THOSE UNITS.WENT ROOM TO ROOM IN THE UNIT AND SHOWED THEM THE TYPE OF VIOLATIONS WE WOULD BE LOOKING FOR. WENT OVER ELECTRICAL, MECHANICAL, PLUMBING, HEATING AND COOLING, SHOWING MR COLTON WHAT WE WOULD BE LOOKING FOR. WENT OVER WINDOWS AND DOORS, APPLIANCES AND INTERIOR FEATURES, EXPLAINING TO HIM OUR EXPECTATIONS. WE XPLAINED THAT IF DNR SAW PROGRESS IN THE WORK AND WHAT WAS GETTING COMPLETED, DEADLINES, ETC.., THAT TIME COULD BE EXTENDED TO THEM. MR COLTON EXPLAINED THAT A MEETING WAS PLANNED WITH MR EVENCHIK THIS AFTERNOON TO GO OVER WITH HIM WHAT COLTON AND COMPANY HAD FOUND OUT. LANNY COLTON DID TAKE PICTURES TO PRESENT TO MR EVENCHIK, MEETING IS TO TAKE PLACE TODAY 9/09/05. MR COLTON EXPLAINED THAT IF HE TAKES OVER THIS UNIT, HE WOULD BE REQUIRING THAT ALL SUB-CONTRACTORS WHO HAVE NOT YET BEEN PAYED, BE PAYED AND THAT A MINIMUM $50,000 IN FUNDS WOULD NEED TO BE MADE AVAILABLE FOR HIM TO TAKE ON THIS PROJECT AND PRIOR TO ANY WORK BEING STARTED. AT THIS TIME TFD ARRIVED ON SITE. PRESENT WERE EFFRIM GRIFFIN AND RON SUMMERS. AGAIN ALL FOUR UNITS WERE WALKED FLOOR BY FLOOR, FIRE POINTING OUT ALL VIOLATIONS THAT THEY WERE ASKING BE CORRECTED. FIRE POINTED OUT THE MOST IMPORTANT AND WHAT NEEDED TO BE ADDRESSED FIRST. AT THIS TIME DNR AGAIN EXPLAINED TO LANNY COLTON THAT FIRE VIOLATIONS WOULD NEED TO BE COMPLETED PRIOR TO BEGINNING THE RENOVATION OF UNITS AND DNR EXPECTATIONS. FIRE WAS ASKED IF THEY WOULD EXTEND TIME, RON SUMMERS DID MENTION THAT IF THEY SAW PROGRESS BEING MADE THAT THEY WOULD EXTEND TIME, (DIFFERENT FROM WHAT WE INITIALLY HEARD FROM EFFRIM GRIFFIN) FOUND TWO MORE UNSECURED UNITS WHILE WALKING COMPLEX WITH FIRE AND ONE UNIT HAD BEEN BREACHED. CALLED ANGEL AND BILL HARBISON WHO WERE BOTH IN AGREEMENT THAT THEY WOULD NOT BE DOING THE BOARD UP DUE TO COLTON AND COMPANY POSSIBLY TAKING PROJECT OVER. THEY FELT THAT COLTON WOULD BE OR SHOULD BE RESPONSIBLE AND WERE UNSURE AT THIS TIME IF THEY WOULD BE RECEIVING FINAL DRAW FOR COMPLETING THE INITIAL BOARD UPS. CALLED MR EVENCHIK AND INFORMED HIM OF UNSECURED UNITS, AND EXPLAINED IF HIS PEOPLE DID NOT TAKE CARE OF THIS ISSUE TODAY THE CITY OF TUCSON WOULD HAVE UNITS BOARDED. HARVEY MENTIONED HE THOUGHT COLTON WOULD BE DOING THIS AND I INFORMED HIM PROBABLY NOT UNTIL HE AND LANNY COLTON CAME TO SOME AGREEMENT. EXPLAINED THAT I WANTED BOARD UP COMPLETED TODAY 9/12/05. NOV FOR 3 UNITS WAS ISSUED AND HAND DELIVERED. NO PICTURES WERE TAKEN. COLTON FULLY UNDERSTANDS THE EXPECTATIONS OF DNR AND FIRE. WILL WAIT FOR RESULT OF EVENCHIK/COLTON MEETING. RECEIVED A CALL FROM LANNY COLTON LATER THIS DAY EXPLAINING THAT HE AND EVENCHIK REACHED AN AGREEMENT AND THAT HIS PEOPLE WOULD HAVE BOARD UP COMPLETED TODAY. RECEIVED CALL FROM JOE OF COLTON AND COMPANY, INFORMING ME THAT HE WAS IN ROUTE TO THE COMPLEX TO ACCESS WORK. EXPLAINED TO HIM HE NEEDED ONLY TO TAKE 10 SEETS OF PLYWOOD, NOT TO WASTE TIME ACESSING THE JOB, BUT TO PICK UP MATERIALS AND HEAD DIRECTLY TO THE JOB. HE SAID HE WOULD DO THAT. |

MET WITH ANGEL (SON) AND INFORMED HIM TO SECURE UNIT 2204, ANGEL MENTIONED THAT HE HAD SEEN DOOR TO UNIT #2308 KICKED IN. CHECKED UNIT AND ASKED HIM TO GO AHEAD AND SECURE THAT UNIT. I WALKED ALL FOUR BUILDING MAKING A LIST OF ALL SECURED UNITS AT THIS TIME. LIST WILL BE INCLUDED IN CASE PACKET. WILL ISSUE NOV FOR TWO NEW UNSECURED UNITS, GIVING OWNER 0 DAYS DUE TO BOARD UP CONTRACTOR ON SITE FINISHING UP. MET WITH ANGEL (SON) WHO CONTACTED HIS FATHER FOR ADDITIONAL PLYWOOD. WHILE WALKING THE SECOND BUILDING, I MET UP WITH ANGEL(SON OF BOARD UP CONTRACTOR) AND ASKED HOW FAR THEY HAD GOTTEN WITH THE BOARDING. ANGEL MENTIONED THAT BUILDING ONE HAD BEEN COMPLETED, BUILDING TWO HAD TWO UNITS UNCOMPLETE, AND THAT BUILDING 3 HAD BEEN STARTED WITH SEVERAL UNITS HAD BEEN COMPLETED WITH SEVERAL REMAINING TO BE COMPLETED. BUILDING 4 HAD NOT BEEN STARTED, HOWEVER HIS FATHER HAD LEFT TO PICK UP ADDITIONAL PLYWOOD. AT THIS TIME ANGEL MENTIONED THAT THEY HAD NOTICED SEVERAL UNSECURED UNITS IN 2&3. I ASKED ANGEL TO WALK ALL BUILDINGS WITH ME SO THAT WE COULD FIND OUT WHAT UNITS WERE UNSECURED AND NEEDED TO BE SECURED SO THAT ADDITIONAL PLYWOOD COULD BE ORDERED. AFTER WALKING ALL BUILDINGS FOUND APPROX 20 UNITS HAD BEEN KICKED IN, OR VACATED IN SOME WAY OR ANOTHER. THERE WERE SEVERAL UNITS KICKED IN EVIDENCED BY THE SCREWS IN DOORS AND DOOR JAMBS THAT HAD CASINGS SPLIT AND TORN OFF THE DOOR FRAME. CALLED ANGEL AND EXPLAINED TO HIM THE ADDITIONAL UNITS FOUND VACANT AND TOLD ANOTHER TWO BUNKS OF PLYWOOD, (132 SHEETS) WOULD BE REQUIRED. A SECOND NOV WAS ISSUED FOR 20 ADDITIONAL UNITS AGAIN GIVING OWNER 24 HRS TO COMPLY. CONTRACTOR ALREADY ONSITE BOARDING UNITS. TRIED MAKING CONTACT WITH HARVEY EVENCHIK TO INFORM HIM OF SECOND NOV, RECEIVED VOICEMAIL AND LEFT A MESSAGE TO PLEASE CONTACT. ASKED MANAGEMENT TO FAX A COPY TO MR EVENCHIKS OFFICE WHICH WAS DONE IN MY PRESENCE. MY REASON FOR FAX WAS TO GET MR EVENCHIK'S ATTENTION ASAP. |

ANGEL MENTIONED THAT THEY HAD BEEN ASKED TO DO THE BAORD UP AND THAT HE WAS THERE TO ACCESS THE DAMAGE, FIND OUT WHAT IT WOULD TAKE TO SECURE THE UNITS, AND GIVE MR EVENCHIK A PRICE TO SECURE THE UNITS, MATERIAL AND LABOR. ANGEL EXPLAINED THAT THEY WANTED TO SECURE WINDOWS WITH THUMB LOCKS, AND SLIDING GLASS DOORS WITH LOCKING PINS. I EXPLAINED TO ANGEL THAT CITY OF TUCSON REQUIRED ALL WINDOWS TO BE BOARDED WITH A MINIMUM 1/2" PLYWOOD AND PREFERRED A NUMBER 8, 3" SCREW- 12 TO 16" ON CENTER. EXPLAINED THAT THE REQUIREMENT WAS DUE TO UNITS BEING BREACHED IN THE NEAR FUTURE AND POSSIBLY HOUSING TRANSIENTS OR UNWANTED PERSONS. ANGEL COMPLETED THE ACCESSMENT USING CITY OF TUCSON REQUIREMENTS, CALLED BILL HARBISON FIRST, AND THEN GAVE MR EVENCHIK HIS COST TO BOARD THE 30 UNITS REQUIRING SECUREMENT AT THIS TIME. BEFORE GIVING HARBISON HIS ANSWER, MR EVENCHIK ASKED IF INSTEAD OF BOARDING THE UNITS, COULD HE BEGIN NOW MAKING REPAIRS AND BRING UNITS INTO COMPLIANCE. CALLED AND SPOKE WITH INSPECTOR 2, R SALDATE, WENT OVER MR EVENCHIKS REQUEST AND EXPLAINED TO RICK THAT THERE WERE 82 VACANT UNITS AND IF MR EVENCHIK WANTED TO BEGIN UPGRADING UNITS THAT THERE WERE AND ADITIONAL 50 SOME UNITS THAT WERE NOT TO BE BAORDED, AND THAT REPAIRS COULD BE STARTED IN THOSE OTHER 50 UNITS AND THEN BOARD UPS TAKEN OFF AND REMAINING UNITS BROUGHT INTO COMPLIANCE. RICK WAS IN AGREEMENT WITH MY REQUEST. MR EVENCHIK ASKED FOR RICKS CONTACT NUMBER, SO THAT PERHAPS HE COULD TRY AND COME TO SOME TYPE OF AGREEMENT WITH RICK. I EXPLAINED TO MR EVENCHIK NOT ONLY DID HE HAVE THE ADDITIONAL 50 UNITS TO BRING INTO COMPLIANCE BUT THAT HE ALSO HAD THE NOV FROM FIRE AND HAD ALL THE FIRE ISSUES TO COMPLY WITH FIRST. I AGAIN REMINDED HIM THAT I EXPECTED TO BE BOARDING ADDITIONAL UNITS, ONCE THE FIRST 30 UNITS WERE BOARDED. AT THIS POINT I REMINDED MR. EVENCHIK THAT TIME WAS A FACTOR AND THAT IF HE DID NOT BEGIN THE BOARD UP USING HIS CONTRACTOR THAT THE CITY OF TUCSON WOULD SECURE THE UNITS. MR EVENCHIK DID ORDER BILL HARBISON TO BEGIN BOARDING THE UNITS. AT THIS TIME I REALIZED THAT THE CONTRACTORS WOULD PROBABLY NOT HAVE ALL UNITS COMPLETED WITHIN THE 24 HR REQUIREMENT DUE TO THE TIME OF WHEN THE OK WAS GIVEN TO BEGIN THE BOARD UP. ADDITIONAL TIME WILL BE GIVEN IF NEEDED DUE TO FACT THAT UNITS HAVE BEEN LEFT IN THE CONDITION THEY ARE IN FOR SOMETIME, SOME UP TO A COUPLE OF YEARS. | |

DNR OBTAINED THE FIRE INSPECTION REPORT AND WILL BE PLACED IN CASE FILE. DNR INSPECTORS WALKED THE 4 BUILDINGS WITH INSPECTOR GRIFFIN TO MAKE SURE FIRE WAS OK WITH THE BOARD UPS, AND INSPECTOR GRIFFIN ASKED THAT THE APT NUMBERS BE WRITTEN ON THE PLYWOOD SECURING THE FRONT DOOR. THIS WAS DONE AS UNITS WERE COMPLETED. |
