THE RESPONDENT SHERRIE STEWART APPEARED WITH THE ATTORNEY, MR RONALD LEHMAN. MR. LEHMAN BEGAN BY WITHDRAWING THE APPEAL THAT WAS PREVIOUSLY FILED BY THE STEWARTS THAT HAD SHIFTED ALL RESPONSIBLITY TO THE LEESEE MR. ANTHONY LEVESS. MR LEHMAN STIPULATED THAT ALL OF THE UNITS WERE VACATED AND THAT THE POWER WAS DISCONNECTED, AS WELL AS THE GAS AND WATER. MR. LEHMAN ALSO THE GAS AND WATER. MR LEHMAN ALSO STATED THAT THE WATER WAS ILLEGALLY "BOOT LEGGED" IN. THE UNITS WERE POSTED WITH "NO TRESPASSING" SIGNS AND THE ORDER FROM THE CONSTABLE HAS BEEN AFFIXED TO WALLS, WINDOWS AND DOOR AT STRATEGIC LOCATION THROUGH OUT THE PROPERTY. THERE WAS MENTION TO THE COURT THAT THE DEPARTMENT OF NEIGHBORHOOD RESOURCES STAFF WILL REQUEST OF TUCSON ELECTRIC POWER AND SOUTHWEST GAS NOT TO RECONNECT UNLESS THERE IS A CITY "CLEARANCE", FURTHERMORE THIS ADDRESS WILL BE "FLAGGED" IN THE CITY'S COMPUTER SYSTEM, PERMITS PLUS, TO NOTIFY OTHER DEPARTMENTS OF UNABATED ISSUES. UPON HEARING ALL OF THE ISSUES, THE JUDGE RENDERED THIS CASE CLOSED, HOWEVER THE ABATEMENT ORDER WILL REMAIN IN EFFECT UNTIL 10/21/06. THERE WAS NO FURTHER SANCTIONS IMPOSED AND THE FINE WAS REDUCED TO $200.00 WITH A BALANCE OF $100.00 DUE TODAY. THERE WAS MENTION THAT THE FENCING AT THE FRONT OF THE COMPLEX WAS INADEQUATE AND A REQUEST BY LYNN SCHARBACH WAS PUT FORTH TO THE COURT TO MAKE ADJUSTMENTS TO THE BARRIERS TO PREVENT EASY ENTRY. THE RESPONDENTS ATTORNEY REJECTED THIS MOTION AS BEING UNCONSTITUTIONAL AND NOT PART OF THE ORIGINAL CITATION WHICH WAS ELECTRICAL IN NATURE. FINALLY BOTH PARTIES AGREED THAT THIS IS A SEPARATE ISSUE. MRS STEWART DID SAY THAT HER HUSBAND MR. ROBERT STEWART IS ALREADY IN THE PROCESS OF EFFECTIVELY CLOSING THE FRONT AND A DUMPSTER IS BEING BROUGHT IN FOR THE GARBAGE AND TRASH THAT WAS LEFT AT THE SITE. CASE CLOSED, JERRY ORTA |

THE PROPERTY WAS SURVEYED AND PHOTOS WERE TAKEN. WE WERE LOOKING FOR ANY NEW WORK DONE TOWARDS AN ABATEMENT OF ANY OF THE LONG STANDING HAZARDOUS CONDITIONS PREVIOUSLY WRITTEN UP. NO CHANGES WERE FOUND. THE HAZARDS STILL EXIST. TENANTS WERE STILL OCCUPYING THE UNITS, LIGHTS ON, TRASH CANS ADJACENT TO DOOR FULL AND THE MANAGER-GEORGE- STIPUALTED THAT RENTERS ARE STILL HERE. A CHECK OF THE COMPUTER PROGRAM PERMITS PLUS ALSO DID NOT BRING UP ANY NEW DOCUMENTATION OF PERMITS OBTAINED OR ANY OTHER ACTIVITY. |

THE PROPERTY HAS BASICALLY DETERIORATED SINCE JIM AND I WERE LAST HERE. THE ONLY IMPROVEMENTS NOTICEABLE HAVE BEEN IN THE INSTALLATION OF THE NEW ROOF (THE RE-INSTALLATION OF THE NEW MISSION TILE ROOF REQUIRES PERMITS, FOR AT LEAST IN EVALUATING THE EXISTING STRENGTH DUE TO DIFFERENT MATERIALS AND OTHER FACTORS). ORTA AND MYSELF HAD TALKED ABOUT WHERE WE ARE HEADING DUE TO STILL HAVING MANY HAZARDS, WE ALSO CONTACTED ANOTHER INSP. INSP. HOLLANDER WHO IS AN ELECTRICAL INSP. FOR DEVELOPMENT SERVICES, INSP. HOLLANDER IS FAMILIAR WITH THIS PROPERTY DUE TO HE WAS AT PROPERTY BACK IN DEC. OF 04, AS TALKING WITH INSP. HOLLANDER HE DOES REMEMBER ISSUES AND PROPERTY, AT THIS TIME WE WENT OVER ALL ISSUES AND EXPLAINED THAT WE ARE LOOKING AT REISSUING A NOTICE AND ORDER FOR 5 DAYS TO VACATE PROPERTY, INCLUDING ALL OCCUPIED UNITS, AT THIS TIME ELECTRICAL INSP. HOLLANDER DID CONCUR DUE TO ALL HAZARDS, ELECTRICAL INSP. HOLLANDER STATED THAT BACK IN DEC. 04 HE WAS RELUCANT TO GRANT REENGERIZING SYSTEM AT THIS TIME, IT WAS AGREED AT THIS TIME TO REINSTATE UNDER A TEMPORARY BASIS TO SEE THAT CERTIN REPAIRS ARE ACCOMPLISHED, 10 DAY TEMPORARY POWER, 20 DAYS TO SECURE A PERMIT AND WORK TO BE STARTED, THIS HAS NOT OCCURED. AFTER TALKING WITH ELECTRICAL INSP. HOLLANDER CALLED INSP. 2 RICK AND SET UP MEETING WITH MYSELF, INSP. ORTA AND INSP. 2 RICK, WENT OVER ALL CURRENT ISSUES AND THAT VERY LITTLE HAS BEEN DONE SINCE DEC. 04, TO DATE, WITH HAZARDOUS CONDITIONS STILL LOOMING OVER PROPERTY IT WAS IN AGREEANCE TO DO 5 DAY NOTICE TO VACATE PROPERTY. |

| 03/17/2005 | INSP - FOLLOW UP CODE ENFORCE | Correction Required | SPECIFIC NOTES AS TO THE UNIT NUMBERS AND THE PHOTOS TAKEN WERE DOCUMENTED BY JIM HURD. THE FOLLOW-UP INSPECTION INDICATED MANY ISSUES THAT WERE PREVIOUSLY DISCUSSED WERE STILL OUTSTANDING OR HAPHAZARDLY ACCOMPLISHED. WALKING AT THE FRONT AREA OF THE SOUTH UNITS REVEALED OPEN ROMEX WIRES HANGING FROM THE EAVES. LIGHT FIXTURES AT THE WALLS BARELY HANGING ON AND EXPOSING THE WIREINGTHAT SHOULD BE CONTAINED IN THE ELECTRICAL JUNCTION BOX. IN SOME CASES THE LIGHT FIXTURES REQUIRED AT THE FRONT OF THE UNITS ADJACENT TO THE DOORS WERE SIMPLY NOT INSTALLED. UPON OPENING OF SOME OF THE PANELBOARDS, THE SITUATION APPEARS TO HAVE REMAINED UNCHANGED FROM PREVIOUS INSPECTIONS, NOTWITHSTANDING THE OWNER'S CLAIM THAT THE ELECTRICAL CONTRACTOR WENT THROUGHOUT THE ELECTRICAL SYSTEM AND TOOK CARE-OF THE IMMEDIATE HAZARDS. UPON RE-EXAMINATION OF RANDOM BOXES AND PANELBOARDS INSPECTOR HURD AND MYSELF IDENTIFIED LOOSE,HOT AND ACING WIRES. IN ONE CASE ONE OF THE WIRES CAME OFF ITS' TERMINAL, WHICH WAS IDENTIFIED AS AN AIR CONDITIONING WIRE. THIS WAS NOT REINSTALLED FOR REASONS NOT TO CROSS ANY BOUNDARIES THAT COULD BE CONSTRUED AS AN ABETMENT TO THE SITE CONDITIONS. THE WIRING CONTAINED WITHIN THE PANELBOARDS ARE HAPHAZARDLY "CRISS-CROSSING" THE INTERIOR OF THE PANELBOARD AND IN SOME CASES STRADDLING THE BUSSING EXPOSING THE CONDUCTORS TO ACCIDENTAL ENERGIZING OR "SHORTING-OUT" BETWEEN TWO DIFFERENT PHASES. THE WIRE BENDING RADIUS REQUIREMENTS MINIMUMS' ARE BEING EXCEEDED ESPECIALLY AT THE SMALLER TERMINATING POINTS WHERE THE CONDUCTOR EXITS IMMEDIATELY WITH A SHARP RIGHT ANGLE. THE PANELBOARDS HAVE NOT BEEN PROPERLY ANCHORED. IT APPEARS THAT SOME CIRCUIT BREAKERS WERE CHANGED IN ORDER TO COMPLY WITH N.E.C. CODE AND MANUFACTURERS' LISTINGS IN REGARDS TO USING THE SPECIFIED BREAKERS "AS LISTED". THE APPROACH TO AND WORKING CLEARANCES IN FRONT OF THE PANELBOARDS AND SERVICE EQUIPMENT WERE FOUND TO BE RESTRICTED WITH STORED ITEMS, DEBRIS AND THE UNEVENESS OF THE TERRAIN. THE GROUNDING ELECTRODE SYSTEM HAS CUT WIRES AND LOOSE CONNECTIONS. THE SYSTEMS' EFFECTIVENESS COMES INTO QUESTION WITH DETERMINING WHEATHER GROUND RODS,WATER LINES OR OTHER GROUNDING SYSTEMS WERE EMPLOYED, NOT TO MENTION METALIC WATER LINES THAT APPEARS TO HAVE BEEN REPLACED WITH NON METALIC LINES. THE SERVICE IS IN A STATE OF DISREPAIR, HOWEVER THAT THE RISER WAS RESUPPORTED AND THE METER BASE REPLACED. THE PARALLEL GUTTERS AT THE SERVICE ARE 'NON RAINTIGHT' AND RUSTING. THE SWITCHING MECHANISM AND THE INTERCONNECTING COMPOSITE MATERIALS USED THERE-IN ARE DETERIORATING, LEAVING THE ABILITY OF THE DISCONNECTS TO 'OPEN' IN CASE OF EMERGENCY TO QUESTION. AT THE REAR OF THE SERVICE BUILDING IS A FEEDER CABLE THAT FEEDS THE NORTH BUILDING WHICH IS EXPOSED TO THE ELEMENTS AND 'SUBJECT TO PHYSICAL DAMAGE' WITH THEONGOING TRANSFORMATIONS AND REPAIRS THAT THE COMPLEX HAS HAD OVER TIME. THE IDENTIFICATION OF FEEDERS, DISCONNECTS AND BRANCH CIRCUITS IS LIMITED AND WHEN IDENTIFICATION TAKES PLACE IT IS ONLY AT ONE END OF THE CIRCUIT. THE BONDING AND GROUNDING OF THE SERVICE EQUIPMENT AND ALL INTERVENING RACEWAYS ARE COMPROMISED DUE TO LOOSE FITTINGS ie. LOCKNUTS, CROOKED ENTRIES AND RUSTED MATERIALS. THIS CONDITION IMPEDES THE RAPID AND SAFE DISIPATION OF ANY FAULT THAT MAY BE IMPOSSED UPON THE ELECTRICAL SYSTEM. ALONG THE NORTH SIDE A CONTINUANCE OF SIMULAR FINDINGS OCCUR AND IN ADDITION THERE IS A 'TRAVEL TRAILER' AREA SET UP WITH THREE PEDESTALS ALL OF WHICH ARE IMPROPERLY INSTALLED, STARTING WITH THE SIX INCHES IN HEIGHT THAT THE G.F.C.I. RECEPTACLES ARE LOCATED. THE PEDESTALS LACK THE PROPER VOLTAGE AND AMPACITY CONFIGURATIONS THAT ARE REQUIRED FOR THE DIVERSITY AS ANTICIPATED BY THE N.E.C. OVERCURRENT PROTECTION IS EITHER LACKING, MISIDENTIFIED, OR IMPROPER. THERE IS NO GROUNDING ELECTRODE SYSTEM ANYWHERE IN THE VICINITY OF THE PEDESTALS. THE ELECTRICAL BOXES ARE LOOSR,OPEN,OVERFILLED AND NON RAINTIGHT. OTHER MISCELLANEOUS ITEMS WERE THE LACK OF COLOR CODEING OR MIS-COLOR CODEING OF CONDUCTORS, MISUSE OF SPLITBOLT CONNECTORS AND DISSIMULAR METALS CONNECTED TOGETHER. |

ISSUES AND PLAN ON WHAT NEEDED TO BE DONE. PLAN WAS PUT IN PLACE, ALSO TALKED ABOUT TIME FRAME. DID EXPLAIN THAT MAC ELECT. INSP. FROM D.S.D. WOULD HAVE TO BE BROUGHT IN ON MEETINGS AND CONVERSATIONS SO ALL ARE IN AGREEMENT ON WHAT IS TO HAPPEN. MR. ELECTRIC WILL START BY GETTING A HOLD OF T.E.P. TO SEE IF CAN GET DROPS TO EACH BUILDING. WILL CALL AND GET ME KNOW WHAT T.E.P. SAYS. LOAD CACULATIONS OF WHAT WILL BE REQUIRED HAS BEEN DONE. CHANGING SERVICE TO 400 AMP, WAITING ON T.E.P. TO SEE WHERE CAN PUT SUBS APPROX 40% OF NOTICE AND ORDER WILL BE COVERED RIGHT UP FRONT WHEN NEW SUBS GO IN AND LINES REMOVED. |
