I have talked to Malena about this site in the recent past, and for you I am providing my comments to your responses for the discrepancies on Malena's last punch list.

1) Water Harvesting will have to be provided in all locations as noted on the approved plans or you will have to provide us with an approved "As-built Drawing" showing all of the areas that have been changed and accepted by both the Zoning and Engineering Departments. These basins were implemented in lieu of a common area water harvesting basin and cannot be eliminated without our approval. Re-establishment of these basins will be required prior to the release of any and all bonds, or the closing of any of the permits and assurances for this site.

2) The cross slopes of the sidewalks cannot exceed 2% at any location on this site, if they exceed 2% they must be removed and reconstructed within our given standards. It appears that some of the driveway areas have been straight graded from the garage slab to the top back of curb, this slope value is too steep. You will need to remove and replace the sidewalks and driveways within the Public Right-of-way, if the private portions of the driveways are not treated in the same manner you may create a tripping hazard at this joint. It is up to the developer to review all that he has constructed and replace what is deficient. If you would like to mark all of the locations that you feel will need to be replaced we will come out prior to your demolition and verify that there are no other locations that need to be removed.

3) It appears that these locations are either near or adjacent to the wheelchair access ramps at the street intersections and should be rather easy for you to determine.

6) Most assure able items that have not been completed prior to the release of 75% of the lots can be bonded as long as they do not pertain to any type of drainage item. You will need to give to me a spread sheet listing all lots, a list of the quantities for each lot ( i.e. sidewalk square feet, driveway square feet, signs, and the cost associated to construct that item. I am currently using the square footage cost of $4.50 for sidewalks, and $6.50 for driveways, all other items I will use your numbers or will check your figures against a list of public construction cost that is provided by the City of Tucson Transportation Department.

8) Noted, be advised that this item will be discussed further with the Transportation Department to see if the proper permits were issued for the construction of the driveway. Penalties may be incurred onto the owner of the site at the time that the driveway was constructed.

9) These slopes will need to be addressed prior to my release of the sites Grading Permit, Assurances, and the closing of the Subdivision itself.

10) This will include all privately owned lands being maintained by the developer as well as any common areas within the subdivision.

11) All excess construction trash, debris, and stormwater control material that is on the site at this time will be removed prior to the release of all bonds, or the closing of all permits and associated assurance and subdivision files.

Please address all of the previously noted items and ensure that all onsite work has been done per the approved plans prior to calling in for final inspections. Feel free to contact me or Malena and ask for us to look at the areas that you will plan on demolishing for repair work, this will help to ensure that you perform those task in the most efficient manner. We will recheck the site once all of the work is complete and will close the project as soon as possible. Please check the thickness of all of the driveways that have been poured within the public "Right-of-way" to verify that they are at a minimal of 6 inches thick. This is one inspection that will be verified prior to final acceptance since the current field conditions indicate that they may only be 4" thick due to the lack of proper expansion paper locations.

Response: The vacant lot 24 has properly constructed water harvesting basins. All other lots listed had properly constructed water harvesting basins as of completion of subdivision grading; further, all lots listed, except lot 24, have been released from assurances and acquired by individual homeowners. The re-establishment of the basins is problematic in that the developer no longer owns the property - property that is deed restricted by the CC&Rs document, which includes individual homeowner responsibility for maintenance of the basins and City of Tucson (but not previous property owner) right of enforcement. The successful re-establishment of these basins will require further discussion among the parties regarding their respective responsibilities, rights, and practicalities.

Response: Please be more specific, perhaps in terms of lot numbers and location on-lot (e.g., sidewalk integrated within driveway vs. stand-alone sidewalk).

Response: The areas described are rather broad in nature. Please be more specific, perhaps in terms of lot numbers and location on-lot (e.g., along lot #XX sideyard, or sidewalk integrated within driveway vs. stand-alone sidewalk).
4) Sidewalks in front of lots 15, 16 and 17 are cracked and need to be repaired.
Response: Noted.
5) Areas between sidewalk and curb in front of lots 12-16 need to be filled
Response: Noted.
6) Lots 1-6 and Lot 22 have not been built on. Sidewalks and signage in front of these areas are missing.
Response: Noted, but the vacant lots are 1-6 and 24. Please advise regarding substitute bonding to be attached to each individual lot, in order to allow final release of subdivision-wide assurances.
7) No Parking signs on Fairland Park need to be addressed. Signs indicate no parking on both sides, while only 1 side of the street has been signed.
Response: Parking was to be provided on one side of the street, according to the Approved Public Sewer & Paving Plans; according to Section 1/1 and 2/1 on Sheet 1 of those Plans, the signs are on the correct side of the street, so the signs are only incorrect in their symbol indicating no parking on both sides. The sign placards should be removed and replaced with the proper type.
8) Lot 22 has added a driveway entrance off of Compass Park Lane that is not shown on the plan.
Response: The driveway in question was apparently added after home and lot closing, but not by the developer or subdivision contractor. The successful re-establishment of the approved lot conditions will require further discussion among the parties regarding their respective responsibilities, rights, and practicalities.
9) Side slope of lot 16 on the northwest corner of Fairland Park and Nebraska needs to be stabilized to prevent erosion into sidewalk area (slope in 100 yr flood plain)
Response: Noted. Again, as the subject lot has been released from assurances and acquired by a private homeowner, the successful establishment of approvable lot conditions will require further discussion among the parties regarding their respective responsibilities, rights, and practicalities.
10) Stabilize all areas disturbed by construction
Response: Agreed, for publicly held and developer owned parcels. Please verify that this comment excludes individual, non-developer owned lots with built houses.
11) Clean site and remove construction debris and stormwater controls.
Response: All of the referenced work has been completed for publicly held and currently developer owned parcels. Since any debris and stormwater controls are on lots that have been released from assurances and acquired by private homeowners, the successful establishment of approvable lot conditions will require further discussion among the parties regarding their respective responsibilities, rights, and practicalities.
12) Provide certification letter from Engineer.
Response: Noted, pending resolution of the other issues addressed herein.

12/01/2008 GRADING - FINAL Correction Required Spoke to Kevin Finn. Kevin wanted to know what needed to be done to complete project. I explained he needed to call in final inspection. I also exlained that all the WH areas need to be installed per the approved drawing and all areas disturbed need stabilizaton.
11/20/2008 GRADING - FINAL Correction Required Contractor needs to remove material from fence line east side. None of the WH areas have been installed.
04/08/2008 GRADING - FINAL Correction Required Issued N.O.V. to Ruben Encinas, Contractor needs to address wash out on site in 7 days. Contractor washing out concrete on top of lots with no controls installed. Contractor violated stormwater ordinance 26-40, #5, 6, 8. If not addressed I will issue a Stop Work Order or a Citation.
06/12/2006 GRADING - FINAL Violation NOV issued for site T06VL00606. Contractor install SWPPP but may not have been in time. Spoke to Rubin in regards to to this issue. Asked Rubin to call if he receives a citation.
