| 03/31/2004 | FOLLOW UP CODE VIOLATION | Compliance | Mr. Weingart came in to discuss the citation he received for the shed in the rear yard of the stated site. (You cited him originally, Pat Mehrhoff ammended citation to become a zoning violation.) Mr. Weingart stated he was in the process of taking the shed apart, as his neighbor would not agree to a reduced setback. He showed me a site plan with the setbacks for the reconstruction of the shed at 6 feet. I advised him the setback must be reviewed by zoning review before he re-erects the structure, despite the fact that the shed is under the size required for a permit. I advised he could plea responsible in court with the minimum fine and abatement or I would take him to court, seek a minimum fine of $250 with follow up compliance hearings and abatement orders. He stated he would check in with the court today with a plea and that his lawyer, Vernon Peltz, was no longer acting on his behalf in this case. He also stated he would call me when ready for inspection. I advised we would seek to dismiss the compliance hearing if he pled responsible and came into compliance before the hearing date. |
