Because the property sits on a higher grade with a steeper slope, rain and weather can cause a washing out of the landscape and risk damaging their property.
The design solution they implemented—a narrow path flanked by structural elements and landscaping—serves a critical purpose in protecting their yard and the integrity of their perimeter wall. Requiring them to expand the walkway to 40 inches in width would likely compromise that structural protection and result in further damage to both private and potentially public property.
At its narrowest, the existing path measures approximately 25 inches and extends to 48 inches at its widest. Given that the surrounding area is not accessible for wheelchairs regardless of this property’s configuration, enforcing full ADA compliance here does not meaningfully improve accessibility. In fact, I believe the homeowners have struck a responsible balance: although not strictly in compliance with the code’s wording, they are honoring its intent by maintaining a clear path while safeguarding their property from erosion and runoff. An exception has been given.
