05/09/2023 COT - ENFC - Code Enforcement - Follow Up In Violation 12:00 PM - Spoke with individual at the site of his business location. Did observe a pile of birdseed in the right of way in front of his business. The individual admits to feeding the birds near the chase bank location and states he does so because he likes animals. Advised him I would be giving him a warning for doing so, he states that he has called the city and was told that there is nothing illegal about what he is doing. He refused to provide his ID for purposes of filling out a Warning Notice and said not to bother because he was not going to stop. I offered to show him the city code on public nuisance, he declined, became angry and said I came into his office like a big shot and then proceeded to yell and use profanities at me. Did drive to the Chase Bank location to take pictures for a citation. Returned to the individuals business location and once again asked for ID. The individual refused to provide identification and 911 was called. TPD responded to the scene and the individual was identified. Citation 6918024 was issued for Public Nuisance and Exterior Hazard or Attractive Nuisance. -VM
08/01/2023 COT - ENFC - Code Enforcement - Follow Up Passed 920 AM - Defendant was present. There has been no further instances of bird feeding since citation was issued. Plea agreement offered and was accepted to dismiss Charge A Public Nuisance in exchange for responsible plea on Charge B Exterior Hazard or Attractive Nuisance. Fine of $164 suspended by Judge. One year abatement order in effect until 08/01/2024. Case closed at this time. -VM
