10/13/2022 T.C. Ch. 16, Sec. 16-33 PLACING REFUSE UPON THE PROPERTY OF ANOTHER OR PUBLIC PROPERTY; ILLEGAL LITTERING OR DUMPING PROHIBITED; PERSONS RESPONSIBLE (a) No person shall place any refuse upon any private or public property not owned or under the control of that person. In addition to any penalty that may be imposed by this chapter or the Tucson Code, such person shall be liable for all costs for the removal, abatement or enjoining of the refuse. (b) No person shall litter, discard refuse, or allow refuse to be discarded except at the places and in the manner authorized in Chapter 15 of this Code. (c) The following persons are jointly and individually liable for a violation of subsection (b): (1) The resident of the property upon which the debris has been discarded; (2) The person who discarded or allowed the debris to be discarded; (3) The person who owns or maintains a refuse container in which refuse is improperly placed or discarded; and (4) The person who generated the refuse. When an item contained in refuse discarded in violation of this section identifies a person, the item creates a rebuttable presumption that the person so identified generated the refuse.

Fiesta Ave. Refuse behind property 5914 S. Fiesta showed drag marks in the back of the alley from property to public right-of-way on the north side of 5902 S. Fiesta Ave. A large pile of similar refuse (cinder blocks and rocks, dirt and dead vegetation) placed in public right-of-way area next to property located at 5902 S. Fiesta Ave on the north side of property. Refuse Collection Driver reported owner was rude towards him when this refuse was not collected. B&B Supervisor met with owner at residence to inform owner City of Tucson does not remove rocks, dirt refuse. States owner became angry and aggressive and slammed door in his face. I inspected site and found drag marks as reported and refuse placed in public right-of-way area as reported. While documenting refuse could hear a man inside house yelling. Did not feel safe. Left sight to avoid person's outburst and confrontation. Sending owner, a notice regarding refuse in public right-of-way and illegal dumping.}
