THE INTERIOR OF THE BUILDING WAS VERY SMOKEY WITH LOUD MUSIC AND A DANCE FLOOR WITH 20 PEOPLE DANCING AND OTHERS ROAMING AND STANDING AROUND THE TOTAL NUMBER OF OCCUPANTS WAS DIFFICULT TO DETERMINE DUE TO SMOKEY ENVIRONMENT AND MOVEMENT OF THE PEOPLE ENTERING AND EXITING. THE ENTRANCE TO THE INTERIOR OF THE BUILDING IS BY WAY OF A REAR SINGLE DOOR. THE BUILDING'S SIDE DOORS WERE NOT BEING USED FOR ENTERING OR EXITING AT THE TIME OF INSPECTION. THERE WAS AN ESTIMATE OF OVER 20 PEOPLE IN THE PATIO AREA . VIOLATION THE HOOKAH LOUNGE BUSINESS IS AN ASSEMBLY USE. THERE IS NO CERTIFICATE OF OCCUPANCY FOR AN ASSEMBLY USE. THERE ARE CONCERNS ON THE OCCUPANCY LOAD USING THE SINGLE REAR DOOR AS A SOLE MEANS OF EXITING THE BUILDING IN CASE OF FIRE OR DISORDER. CITY OF TUCSON ACTION AND ORDERS A STOP WORK ORDER WAS ISSUED 0 DAYS: THE HOOKAH LOUNGE BUSINESS SHALL CEASE AND A PLACARD WHICH READS STOP WORK ORDER WAS POSTED ON THE BUILDINGS WINDOW. A 24 HOUR NOTICE OF VIOLATION WAS ISSUED TO REMOVE ALL SIGNAGE RELATED TO THE HOOKAH LOUNGE. THIS NOTICE WAS SIGNED BY THE BUSINESS OWNER TUCSON POLICE DID HAVE ALL OCCUPANTS REMOVED. I DID ADVISE THE OWNER THAT IF THE STOP WORK ORDER IS VIOLATED DUE TO AN ASSEMBLY USE CONTINUING, THEN MORE RESTRICTIVE ACTION SHALL TAKE PLACE SUCH AS: BUILDING CONDEMNATION AND CODE ENFORCEMENT WILL REQUEST THE BUILDING OFFICIAL TO REVOKE THE RETAIL CERTIFICATE OF OCCUPANCY. |
