Unless otherwise exempt pursuant to section 301 of the Administrative Code, as adopted by reference per section 6-1 of this Code, or pursuant to any other ordinance or statute, no building, structure or building service equipment regulated by this chapter or by the technical codes adopted by the city shall be built, erected, constructed, enlarged, altered, repaired, moved, improved, removed, converted or demolished unless a permit first has been obtained from the building official in the manner provided in the administrative and building codes adopted by the city. The purpose of a permit is to ensure that all construction is inspected by qualified City of Tucson personnel as directed by ordinance to verify compliance with city codes. Failure to obtain proper permit with inspections and approvals shall deem the construction to be unsafe. |

I DID NOTICE THAT THE OTHER BAY DOOR HAS BEEN ENCLOSED AND NOW HAS A NEW WINDOW WITH LIGHTING. THIS WORK WAS DONE WITHOUT PERMITS. A PERSON CAME OUT FROM THE REAR OF THE BUILDING. WHEN QUESTIONED ABOUT WHAT ACTIVITY IS BEING PERFORMED INSIDE THE GARAGE PORTION OF THE BUILDING HE SAID NOTHING AND THAT HE WAS CLEANING. TPD ARRIVED AND THEN THE BUSINESS OWNER OF THE SMOKE SHOP ARRIVED. I DID HAVE A CONVERSATION WITH THE ARCHITECT WHO STATED THAT HE HAS BEEN HIRED BUT NO SUBMITTAL AS OF TODAY. THE FUTURE PLANS ARE FOR THE SMOKE SHOP TO CONTINUE AND THE GARAGE PORTION OF THE BUILDING WILL BE AN ICE CREAM SHOP. HE STATED THAT THE BUILDING HAS BEEN PARTITIONED, I SAID I'M NOT AWARE OF THAT BEING DONE UNDER A PERMIT. I DID ADVISED OF THE CITY'S ACTIONS AND HE SAID HE WILL STAY IN TOUCH AND REPORT ANY MOVEMENT FORWARD FROM HIM. THE BUSINESS OWNER REFUSED TO SIGN THE CITATION FOR FAILURE TO OBTAIN A CERTIFICATE OF OCCUPANCY AND THE ORDER TO VACATE. HE DID ACCEPT BOTH THE ORDER AND THE CITATION. HE WAS SERVED BY ME. THE OWNER'S REPRESENTED ARRIVED LATER, SHE IS THE GRAND DAUGHTER. I ADVISED HER THAT THE OWNER WILL BE CITED FOR WORK WITHOUT PERMITS AND TO CONTINUE WORKING WITH THE ARCHITECT. I ALSO ADVISED THAT THE OWNER IS IN FULL CONTROL OF THE BUILDING AND HE IS RESPONSIBLE TO MAINTAIN CONTROL AND OVERSITE. SHE WAS ADVISED THAT POLICE WILL CONTINUE TO MONITOR. I DID EXPLAIN IN DETAIL THE CITY'S ACTIONS AND RESTRICTIONS WHICH ARE AS FOLLOWS: " NO OCCUPANCY ALLOWED " NO BUSINESS ACTIVITY OR PUBLIC ACCESS " THE BUSINESS IS ALLOWED OCCUPANCY TILL 5 PM TODAY ONLY, THEY MAY RETURN TO REMOVE THEIR BUSINESS RELATED ITEMS. " THE OWNER'S REPS / CONTRACTORS MAY ACCESS THE BUILDING FOR THE PURPOSE OF ABATEMENT. " VIOLATION OF THESE ORDERS WILL RESULT IN TERMINATING POWER AND BOARDING THE BUILDING. |
