04/25/2014 INSP - INITIAL CODE ENFORCMENT PUMPHREY Approved Vacant structure (previously "the Grill") at 110 E Congress (multi unit commercial building) exists in a dilapidated condition due to fire damage previously sustained in 1/1/13 and lack of subsequent repair. Structure is unable to be occupied in its current condition and presents an attractive nuisance to area community. Structure interior, roof, and rear exterior wall has been previously demolished, leaving only front façade and exterior wall, with possible compromise of structural integrity on other portions of the building. The facade does have support beams installed as a temporary measure. The current condition of the building unit is allowing moisture and pests to penetrate structure interior as well as becoming a nuisance for trespassing and graffiti. Graffiti is present on the interior and exterior of building. Fencing is present, but is loose and needs adjustment; structure is not posted with no trespassing signs.

All accumulated refuse that poses a fire or health hazard within or upon the property or premises shall be removed; and b. All unsecured doorway, windows, or exterior openings shall be barricaded in accordance with standards established by the code official, which shall be kept on file with the city clerk, and in accordance with section 16-12(a)(3) of this chapter; and c. Both the structure and the exterior premises shall be posted with signs that provide reasonable notice prohibiting entry (i.e., "No Trespassing" signs). Not Approved
05/01/2014 T.C. Ch. 16, Sec. 16-30. GRAFFITI PREVENTION, PROHIBITION AND REMOVAL. (a) Graffiti prohibited, abatement procedures, penalty. No person who owns or is in control of any real property within the city shall maintain, permit or allow graffiti to remain on any building, fence, structure or otherwise on such property where the graffiti is visible from the street or other public or private property. (b) Notice of violation and abatement. Upon the receipt of notice requiring abatement from the graffiti abatement official, any person owning or otherwise being in control of the property shall remove or abate all graffiti within the time frame specified in such notice. The graffiti abatement official shall give notice utilizing the procedures set forth in section 16-45 of this chapter, except that the notice need not include a statement describing the right to an administrative appeal, since none exists. The graffiti abatement official may cause the removal of graffiti from private property should the property owner or person in control fail to remove graffiti after the required notice. The city or its authorized representative is expressly authorized to enter private property and abate graffiti. Not Approved
