Unless otherwise exempt pursuant to section 301 of the Administrative Code, as adopted by reference per section 6-1 of this Code, or pursuant to any other ordinance or statute, no building, structure or building service equipment regulated by this chapter or by the technical codes adopted by the city shall be built, erected, constructed, enlarged, altered, repaired, moved, improved, removed, converted or demolished unless a permit first has been obtained from the building official in the manner provided in the administrative and building codes adopted by the city. The purpose of a permit is to ensure that all construction is inspected by qualified City of Tucson personnel as directed by ordinance to verify compliance with city codes. Every dwelling unit, guest room, and congregate residence shall be provided, in at least one habitable room, with either mechanical cooling or an alternate cooling method. Cooling facilities shall be installed and maintained in a safe condition and in accordance with the manufacturer's recommendations, and shall be capable of providing adequate cooling, appropriate for the climate, to assure a safe living environment. Evaporative cooling shall be maintained to be free of excessive rust, corrosion or mineral deposits that limit proper operation. Any mounting apparatus for a cooling facility must be structurally sound. Mechanical fans or portable evaporative cooling devices may only be used on a temporary basis as the sole source of cooling when the permanent cooling system is being repaired or replaced. |

An owner of residential rental property shall maintain with the assessor in the county where the property is located information required by this section in a manner to be determined by the assessor. This subsection does not affect any lease existing on August 6, 1999. (e) A person who fails to comply with any provision of this subsection is responsible for a civil infraction and shall be assessed a civil penalty of one thousand dollars ($1,000.00), plus an additional one hundred dollars ($100.00) for each month after the date of the original violation until compliance occurs. The court shall not suspend any portion of the civil penalty provided by this subsection. |

SIDE OF THE STRUCTURE WHERE THE UTIILTY ROOM WAS LOCATED. MRS. JORDAN SHOWED THE HOTWATER HEATER AND THE A/C UNIT BOTH LOCATED IN THE SAME ROOM. FOUND THE HOTWATER HEATER HAD BURN MARKS ON THE UNITS HEATING ELEMENTS, TOP AND BOTTOM, AND THE UNIT HAD BEEN RECENTLY REWIRED TO HOPEFULLY KEEP THE UNIT RUNNING OR WORKING. THE BURN MARKS ON THE UNIT WAS A RED ALERT FOR A POSSIBLE FIRE DOWN THE ROAD IF THE UNIT REMAINS AS IT IS BECAUSE OF THE ILLEGAL WIRING OF THE UNIT. DRAIN LINE FROM THE A/C UNIT WAS FOUND DAMAGED AND LEAKING, AND OCCUPANT MENTIONED THE UNIT WOULD ONLY WORK WHEN TURNED DOWN TO 70 DEGREES INDICATING THAT THE COOLING ELEMENTS OR THE COILS WERE PROBABLY FROZEN OVER, A MAINTANENCE ISSUE. FOUND MISSING DRYWALL IN THE N/W BEDROOM AS WELL AS A MISSING SMOKE DETECTOR. RESEARCH FOUND THE UNIT BEING USED A RENTAL UNIT, ASSESSORS PAGE SHOWS IT AS OWNER OCCUPIED. ** CALLED AND SPOKE TO OWNER (10/11/2011) OWNER MENTIONED HOTWATER HEATER HAD BEEN REPLACED AND A/C UNIT TO BE FIXED. MENTIONED TO MR. PATTERSON THAT A PERMIT WAS REQUIRED TO REPLACE THE A/C UNIT AND A INSPECTION BY DSD COMPLETED. MR. PATTERSON ARGUED THAT THE WORK WAS ALREADY COMPLETED, EVENTUALLY CALLED ME A S.O.B. AND HUNG UP, I FULLY EXPECT MR PATTERSON TO BE DIFICULT TO WORK WITH. DID SPEAK TO CARLOS PORTILLO ALBOUT THE PHONE CALL, THE CASE, THE RESIDENTIAL RENTAL PORTION AND HOW TO PROCEED. |
