08/03/2010 | T.C. Ch. 16, Sec. 16-14(b) Vacant and unsecured buildings or structures are unlawful and are prohibited by this chapter. The requirements of this subsection (b) shall apply to all vacant and unsecured buildings or structures regardless of whether or not the building or structure is surrounded in whole or in part by a fence or wall. (1) Duty to clean, secure and prohibit trespass. The owner or responsible party of a vacant building or structure shall remove any accumulation of weeds, combustible waste, or refuse from the interior of the building or structure and the surrounding yards; and shall secure all doors, windows, and other openings to prevent unauthorized entry. The owner or responsible party also shall post both the structure and the exterior premises with signs to provide conspicuous and reasonable notice prohibiting entry (i.e., "No Trespassing" signs). |

08/02/2010 | INSP - INITIAL CODE ENFORCMENT | JVALDEZ | Approved | I WAS DISPATCHED TO AN EMERGENCY CALL OUT BY TUCSON POLICE. A ROOM IN A VACANT AND NEGLECTED BUILDING WAS BEING USED AS A DWELLING. THERE WERE NO TRESPASS SIGNS ON THE PROPERTY OR ON THE BUILDING. THE POLICE OFFICERS WERE CONCERNED ABOUT THE STRUCTURES STABILITY AND HAD RECEIVED REPORTS OF SOMEONE LIVING IN THE BUILDING. AT THIS TIME I ENTERED THE PROPERTY AND CONDUCTED AN INSPECTION OF ALL THE OPENINGS. I FOUND ONE ROOM THAT HAD AN OPERABLE SINK, TABLE AND SHELF WITH FOOD CONTAINERS, BED AND CLOTHING. THERE IS A BATHROOM WITH A SINK, TUB, SHOWER AND HYGIENE ITEMS. THERE IS WATER TO THE PLUMBING FIXTURES. NO HOT WATER. THE DISCONNECT HAS NO METER, NO POWER TO THE BUILDING. THIS WAS SUFFICIENT EVIDENCE THAT THE BUILDING WAS BEING USED AS A DWELLING. THE EXTERIOR HAS ANOTHER BED IN THE YARD WITH CLOTHES HUNG ON A LINE. THE NEXT ROOM HAD 12 JACKS SUPPORTING THE ROOF RAFTERS TO THE OPENING AND THE INTERIOR OF THE ROOF. THIS ROOM IS ADJACENT TO THE ONE BEING USED AS A DWELLING. I ENTERED THE REMAINING ROOMS AND SAW JUNCTION BOXES WITH EXPOSED CONDUCTORS LOCATED IN THE CEILINGS AND WALLS. NONE OF THE OTHER ROOMS HAD ANY SIGNS OF ANY USE. THE BUILDING HAS BEEN NEGLECTED AND IS DILAPIDATED, PORTIONS OF THE BUILDING HAS HAD THE PLASTER FINISH COLLAPSE EXPOSING THE ADOBE. THE FRONT OF THE BUILDING HAS OPENINGS THAT HAVE BEEN BOARDED. THERE IS A CHAIN LINK FENCE SURROUNDING THE NORTH END OF THE BUILDING WHICH HAS A WALL MADE OF ADOBE THAT HAS COLLAPSED. POLICE CONFRONTED A MALE CAUCASIAN MAN WITH A DOG WHO STATED HE HAS BEEN LIVING IN THE BUILDING FOR OVER 6 YEARS. MY FINAL EVALUATION OF THE CONDITION OF THE BUILDING IS AS FOLLOWS. I DEEMED THE BUILDING TO BE UNSAFE TO OCCUPY DUE TO THE STRUCTURAL DAMAGE AND LACK OF POWER. I CALLED GREG CLARK BY PHONE 520 661-1316 WHO IDENTIFIED HIMSELF AS THE OWNER THE PROPERTY. I INFORMED HIM OF MY ACTIONS AND POLICE PRESENTS. I DID EDUCATE HIM ON THE CITY ORDINANCES AND THE BUILDING CODE. THE BUILDING WAS POSTED WITH THREE POSTING STATING DO NOT ENTER, UNFIT TO OCCUPY PURSUANT TO TUCSON CITY CODE 16-14. |

FOLLOW UP INSPECTION WILL BE ON FEB 2011 ADMINISTRATOR WILL CONTINUE TO PROVIDE DIRECTION AND UPDATES. |
