Description:
Assisted living- pool is not fenced- an elderly man got too close and fell in. Wheelchair & motorized chair scooters parked near stairwells, also parked all over the place and when paramedics ar called hard for them to get in. Feels it is very unsafe.

Monday, April 23, 2007 Laure Mendenhall, General manager Broadway Proper 400 S. Broadway Place Tucson, AZ 85710 RE: Pool Safety and Blocked Hallways to Dining Area. Dear Laure Mendenhall: On 4-19-07 we received a complaint involving blocked exit access around the dining area and the lack of a pool fence. (TO7FR00772 ) Blocked Exits: The changing mobility choice of the people living at Broadway Proper has created a new challenge for the storage of personal walkers and scooters during group functions. The plans you have in place seem to be working, but if the problem continues you may have to remove the piano to make more room for the parking of the devices. See attachment for clearances. You may want to check with ADA requirements for the dining room and any group activities. At the time of the inspection the corridors where not blocked, and a " No Violation at this Time " will be issued from this complainant. Pool Fence: The pool was build in 1988 and was not required to have a fence and is not in violation of the city building or fire safety codes but remains a liability for person not able to rescue themselves if they would fall into the pool. See recommendation pool safety A "No Violation at this Time" will be issued for the pool fence. Steve Higginbottom Fire Inspector Fire Prevention Section Recommendation for pool safety: A pool still remain an area of danger for the public that has either undeveloped or diminished captaincies to rescue it self from a body of water that is greater than 18" deep. The facts show that fall injuries are the number one cause of senior's loss of independence and their mortality. Reducing their life to partial or total depend care for their survival. When we couple the facts about fall injuries and a lack of a pool barrier, the area around the pool has a high risk factor for toddlers and seniors. 1. The recommendation would to voluntarily comply with the current pool safety code to reduce you liability. 2. Place landscaping around the water works that would keep someone 2' from the waters edge. 3. Place a 34" high handrail along side of the bridge to the spa. 4. During a group function have a soft barrier around pool to increase awareness of the pool's edge. 5. Have a phone near pool to call 911. 6. Enhance awareness of safety equipment near the pool. |
