| 03/01/2007 | INSP - INITIAL CODE ENFORCMENT | DCOX | Approved | Inspector Hector Lopez investigated a complaint of the same nature in 2003 in which it was determined the trailer is allowed to be on the property as a storage shed. Per Officer Wilson, TPD, there is a known illegal drug operation occurring a this address. The following is an account of communication between Officer Wilson, Jan Koehn, Lucy Valdez and myself; Hi Officer Wilson, Dave Cox and his supervisor forwarded your emails to me regarding this problem. We can't think of any agency that would be able to respond to this type of activity. Enforcement agencies of any sort are going to have to grapple with the same limitations of what they can enforce based upon allegations and suspicion - which, as you know, isn't much. If you ever have cause to be in the backyard and are able to ascertain that there are definitely utilities to the unit we can send a notice to the owner for that violation, but we don't have any evidence right now to take that step, and due to safety concerns, I'm not comfortable sending a code inspector into a property with probable drug activity to check for potential violations. Unfortunately, as Dave Cox had indicated, the trailer was approved to be on site, and the only possible violation that we would ever have is illegal electrical connections, that we could require to be removed. It wouldn't however, mean that the folks wouldn't reconnect them once we inspected for compliance. I did get your first email, 02/17/07, however the past few weeks have been rather busyfor myself. I did look into the addressin question. One of our Inspectors had a case there in April of 2003and it was determined that the trailer is approved to be thereas a storage unit. Ispoke to my supervisor, Lucy Valdez, and she concurs that there is little we could do from our scope of enforcement. According to your first communication the trailer is not being used in it's "approved and intended" purpose, i.e. a storage unit but rather as a Crack Cocaine Kitchen and distribution center. After the illegal drug operation is stopped and the trailer is cleared of all Bio-Hazard, if the trailer is not being used as approved, DNR could conduct an inspection to determine which codes and ordinances, if any, are in violation and address those with the property owner. However at this time DNR is not inclined to get involved with an on-site inspection as long as there is known illegal drug activity taking place. I am looking for some help with a project of mine. It's been brought to my attention the trailer in the back yard at 1042 E 31st St. in the South Park Neighborhood is moving 2-3 Kilos of cocaine through it per week. It's primarily caught up in cooking crack and it is a problem. From what I hear, it has been there for years. It appears that there is utilities run to it and that it won't be moved anytime soon. I would appreciate it if you could have a look-see at it and see if we can get it taken care of. Ultimately, I'd like to have it removed, but in the end I guess it is up to you.
