12/07/2006 INSP - FULL JDAVIS Correction Required This is a Automobile repair shop in a residential area. I ordered the Owner, (Jeff McConnell) to clean up the spilled oil. I also advised him that this kind of operation can not be conducted in a residential area. He told me that he has been there for 8 years. He has no business license or C of O. I called DNR (791-5843) Property complaint department and spoke to Chris. I asked them to deal with the issue. I was told that Hector Lopez was assigned (791-5843 x75021) I took Pictures December 5, 06 THe Following letter was given to Mr. Mc Connell: December 11, 2006 Jeffrey Mc Connell 4834 E. 28th St. Tucson, AZ. 85711 RE: Release of Hazardous Materials on Ground Dear Mc Connell: On the above date, in response to a complaint received by this Office, an inspector was dispatched to your property. During the inspection it was noted that there was an unauthorized release of hazardous material at the above address. The hazardous material was identified as oil. The Tucson Fire Code, Section 2703.3/ 2703.3.1.4 states: "Hazardous material is any quantity shall not be released into a sewer, storm drain, ditch, drainage canal, creek, stream, river, lake, tidal waterway, or on the ground, sidewalk, street, highway or into the atmosphere." "Any person, firm or corporation responsible for any unauthorized discharge shall institute and complete all actions necessary to remedy the effects of such unauthorized discharge at no cost to the jurisdiction." The Tucson Fire Department has the responsibility of enforcing the fire code, as well as assisting the Arizona Department of Environmental Quality investigate violations of environmental regulations. As the property owner, it is your responsibility to initiate and complete the clean-up of all contaminated soil within 14 days of this notice.
